Resolution to Certify Seven Streets for the Purpose of Obtaining Funds under Act 51, P.A. 1951 as Amended
Memorandum
Public Act 51 of 1951, as amended, requires that road segments must be shown on the official Act 51 map in order to receive funding from the State of Michigan's Weight and Gas tax. City staff recently identified six locations where local streets are present but not shown on the Act 51 Map. These locations include:
* East Eisenhower Parkway Service Drive (north of Eisenhower; west of King George)
* East Eisenhower Parkway Service Drive (south of Eisenhower; east of King George)
* Hikone Road (Packard to end of public right-of-way)
* Jones Service Drive (Jones Drive to end of roadway)
* Nixon Road Service Drive (approximately Huron Parkway to Bluett)
* Seybold Drive (Dexter to end of public right-of-way)
In addition, a portion of St. Regis Way, from Pontiac Trail to the north edge of 2601 Pontiac Trail, was constructed as a public street as part of the "University Trails" development (formerly "The One, formerly "The Cottages at Barton Green"). This portion of the street has now been accepted by City staff, and the easement for this portion of the street has been recorded. Therefore, this portion of St. Regis Way is also being included in this Resolution.

Addition of streets to the Act 51 map requires certification by City Council, which can be accomplished by the approval of this Resolution. Approval of this Resolution will add approximately 0.92 miles of roadway to the City's road system. Certification will not change the functional use of any of the streets listed herein.
Upon approval by City Council, the Street Administrator for the City will have these locations added to the Act 51 map prior to submitting the certified copy back to the State of Michigan in the spring of 2026.

Whereas, Several street segments within the City of Ann Arbor were found to be absent from the official Act 51 map, and it is necessary to furnish certain information to the State of Michigan to place these streets within the City of Ann Arbor Street System for the purpose of obtaining funds under Act 51, P.A. 1951, as amended; and
Whereas, the City of Ann Arbor did on December 20, 2024 obtain an easement for Right-of-Way over St. Regis Way within the University Trails development at 2601 Pontiac Trail, and it is necessary to furnish certain information to the State of Michigan to place this street within the City of Ann Arbor Street System for the purpose of obtaining funds under Act 51, P.A. 1951, as amended;

RESOLVED, That the above-described streets are public streets and are for public street purposes;
RESOLVED, That the above-described streets are accepted into the City of Ann Arbor municipal street system and are open to the public for public use before December 31, 2025;
RESOLVED, That the City's Street Administrator be authorized to submit these changes to the State of Michigan to alter the official City of Ann Arbor Act 51 Certification Map to reflect these certifications, and to submit this resolution to the State; and
RESOLVED, That the City Administrator be authorized to take necessary administrative actions to implement this resolution.
