Whereas, The Kroger Co. of Michigan, a Michigan corporation, is the owner of property commonly known as 400 S. Maple Road, Ann Arbor, Michigan 48103; and
Whereas, The Kroger Co. of Michigan, a Michigan corporation, has signed a grant of easement for sanitary sewers and appurtenances as shown and described in the attached easement and map and as follows:
A 36-foot wide sanitary sewer easement, being located in the Southeast ¼ of Section 25, Town 2 South - Range 5 East, City of Ann Arbor, Wasthenaw County, Michigan, being more particularly described as: Commencing at the East ¼ corner of said Section 25; thence South 00 degrees 28 minutes 00 seconds West, along the East line of said Section 25, 326.00 feet to the Northeast corner of a 68-foot wide sanitary sewer easement recorded in Liber 3352, page 109, Washtenaw County Records; thence North 89 degrees 06 minutes 36 seconds West, along the North line of said sanitary sewer easement recorded in Liber 3352, page 109, 651.63 feet to the Northwest corner of said sanitary sewer easement recorded in Liber 3352, page 109, and the Point of Beginning of this 36-foot wide sanitary sewer easement; thence continuing North 89 degrees 06 minutes 36 seconds West, 15.53 feet; thence South 45 degrees 22 minutes 36 seconds West, 212.15 feet; thence South 00 degrees 52 minutes 53 seconds West, 92.46 feet to the North line of Radiant Church of Michigan’s property described in the Covenant Deed recorded in Liber 5201, page 82, Washtenaw County Records; thence South 89 degrees 45 minutes 45 seconds East, along the North line of Radiant Church of Michigan’s property, 36.00 feet; thence North 00 degrees 52 minutes 53 seconds East, 77.33 feet; thence North 45 degrees 22 minutes 36 seconds East, 182.32 feet; thence South 89 degrees 06 minutes 36 seconds East, 0.42 feet to the Southwest corner of said sanitary sewer easement recorded in Liber 3352, page 109; thence North 00 degrees 53 minutes 24 seconds East, along the West line of said sanitary sewer easement recorded in Liber 3352, page 109, 36.00 feet to the Northwest corner of said sanitary sewer easement recorded in Liber 3352, page 109 and the Point of Beginning of this variable width sanitary sewer easement.
RESOLVED, That the City of Ann Arbor hereby accepts this grant of easement.
