Attached for your review and approval is a resolution to approve Amendment Number One to the First Amended and Restated General Services Agreement with Recycle Ann Arbor (RAA) for Operation of the Drop-Off Station (DOS) at 2950 East Ellsworth Road (Estimated Cost one-year Amendment of $133,602.84 and one 1-year Renewal up to $137,610.96 subject to the availability of funding, with an estimated Total Value of $271,213.80).
The DOS has been a valuable service to City residents and businesses, accepting a wide variety of materials that are not a part of the weekly curbside collection programs. The DOS promotes a circular economy by providing an outlet for residents to manage unwanted materials by diverting, reusing, and recycling to a higher and best use. The DOS provides an opportunity for users to drop-off single stream recyclable materials (glass, paper/fiber, plastics, mixed metals, scrap/white goods), bulky items (propane tanks, styrofoam, unfinished wood/pallets, yard waste), automotive items (tires, batteries, motor oil filters, motor oil and transmission fluid), textiles, vegetable oil, document shredding, electronics, film plastics, fluorescent bulbs, and freon appliances.
The site and buildings at the DOS are owned by the City of Ann Arbor. RAA is responsible for providing all management, supervision, personnel, materials, equipment, services, and supplies necessary to operate the DOS. In addition, RAA is responsible for disposing and/or marketing all of the materials brought to the DOS. RAA does not pay any rent to the City for use of the DOS premises. RAA also does not share any revenue with the City from the sale of recyclable materials that RAA collects at the Drop-Off Station. The current General Services Agreement between RAA and the City of Ann Arbor for Operation of the DOS expires on December 31, 2024.
This Amendment Number One to the First Amended and Restated General Services Agreement provides that Ann Arbor residents that present an authorized voucher from the City will get unlimited and free DOS access. These vouchers will cover the entry/gate fee for residential users and will provide for the free drop-off of items accepted under the entry fee, including paper, cardboard, plastics, metal, glass, food and beverage containers, and up to three bags of textiles/used clothing. In addition, Ann Arbor residents with a voucher may bring up to five banker boxes of paper to annual shredding events held at the DOS. If an Ann Arbor resident does not present a voucher upon arrival or is bringing a commercial load of materials, then the resident will pay at least a $4.00 entry/gate fee. The voucher program does not extend to commercial users and uses. The voucher program summarized above is similar to the voucher programs currently in place for Ypsilanti, Pittsfield Township, and Lodi Township residents who use the DOS.
RAA complies with the City’s Non-Discrimination and Living Wage ordinances.
Budget/Fiscal Impact: Funding for the services provided by this contract is available in the approved Fiscal Year 2025 Solid Waste Fund Budget and will be available in future fiscal years if so, approved by Council.

Whereas, Recycle Ann Arbor (RAA) has a history of providing extensive services at the City’s Drop-Off Station (DOS);
Whereas, The City’s DOS supports the establishment and growth of a local circular economy and gives residents a way to manage unwanted materials by diverting, reusing, and recycling materials to a higher and best use;
Whereas, The Drop-Off Station has been a valuable service to residents and businesses, accepting a wide variety of materials that are not part of the curbside collection programs;
Whereas, The current General Services Agreement between RAA and the City of Ann Arbor for Operation of the DOS expires on December 31, 2024;
Whereas, Funding for this amendment is available in the approved Fiscal Year 2025 Solid Waste Fund Budget; and
Whereas, RAA complies with the City’s Non-Discrimination and Living Wage ordinances;
RESOLVED, That City Council approves Amendment Number 1 to the First Amended and Restated General Services Agreement with Recycle Ann Arbor in the amount of $133,602.84 for operation of the Drop Off Station;
RESOLVED, That the City Administrator is authorized to approve a one-year renewal of the agreement on the same terms and for an amount not to exceed $137,610.96 subject to the availability of funding;
RESOLVED, That the Mayor and City Clerk are authorized and directed to execute this agreement after approval as to form by the City Attorney and approval as to substance by the City Administrator; and
RESOLVED, That the City Administrator is authorized to take all necessary administrative actions to implement this resolution, including the authority to approve amendments, extensions and renewals.
