Memorandum

Attached is a resolution to approve two separate purchase orders with Lumen for the costs to relocate underground fiber optic facilities in the Michigan Department of Transportation railroad right of way and owned by Level 3 Communications, LLC and CenturyLink Communications, LLC, both Lumen affiliates, in connection with the Barton/Bandemer Park Pedestrian Tunnel Project.

 

The Barton/Bandemer Park Pedestrian Tunnel project will include construction of a pedestrian tunnel that will extend beneath the Michigan Department of Transportation (MDOT) railroad tracks between Barton Nature Area and Bandemer Park which will provide a highly desired non-motorized connection between those parks and fill a critical gap in the Border-to-Border Trail (B2B), which is a part of the statewide Iron Belle trail.

 

Construction of the tunnel is anticipated to occur in summer/fall of 2025.

 

In order to construct the tunnel, the fiber optic facilities owned and operated by Level 3 Communications, LLC and CenturyLink Communications, LLC, both Lumen affiliates, must be relocated within the MDOT railroad right-of-way at the City’s expense. Lumen has provided estimated costs for this relocation work and requires a written financial commitment and purchase order.

 

Staff recommends that City Council approve purchase orders with Lumen for up to $70,996.00 and $44,793.00 for Relocation of Fiber Optic Facilities Owned by Level 3 Communications, LLC and CenturyLink Communications, LLC, both Lumen affiliates, for the Barton/Bandemer Park Pedestrian Tunnel Project (Total $115,789.00). A 10% contingency for each purchase order ($7,000 and $4,500 for total of $11,500) is requested to cover potential change orders to be approved by the City Administrator. It is requested that the purchase orders and contingencies be approved without regard to fiscal year.

 

Budget/Fiscal Impact: The estimated cost for this fiber relocation work is included in and will be paid from the Barton/Bandemer Park Pedestrian Tunnel Project budget, and these costs will be allocated among the parties according to the cost sharing agreements.

Whereas, The Barton/Bandemer Park Pedestrian Tunnel Project seeks to connect Ann Arbor to the communities further west including Delhi and Dexter;

 

Whereas, This project will construct a pedestrian tunnel that will extend beneath the Michigan Department of Transportation (MDOT) railroad tracks between Barton Nature Area and Bandemer Park;

 

Whereas, In order to construct the project, the fiber optic facilities owned and operated by Level 3 Communications, LLC and CenturyLink Communications, LLC, both Lumen affiliates, must be relocated within the MDOT railroad right-of-way at the City’s expense;

 

Whereas, Lumen has provided the City with cost estimates for the fiber location work for this project and requires the City to provide a formal written financial commitment and a purchase order for the estimated cost of the relocation work with final billing to occur upon project completion; and

 

Whereas, Funding for the Lumen fiber optic relocation costs is available in the existing Barton/Bandemer Park Pedestrian Tunnel Project budget and these costs will be allocated among the City, County and HWPI according to the applicable cost sharing agreements;

 

RESOLVED, That City Council approve a purchase order to Lumen in the amount of $70,996.00 for the costs to relocate Level 3 Communications, LLC fiber optic facilities in connection with the Barton/Bandemer Park Pedestrian Project;

 

RESOLVED, That a contingency in the amount of $7,000.00 (10%) be established for the purchase order for the Level 3 Communications, LLC fiber relocation and that the City Administrator be authorized to approve change orders not to exceed the contingency amount;

 

RESOLVED, That City Council approve a purchase order to Lumen in the amount of $44,793.00 for the costs to relocate CenturyLink Communications, LLC fiber optic facilities in connection with the Barton/Bandemer Park Pedestrian Project;

 

RESOLVED, That a contingency in the amount of $4,500.00 (10%) be established for the purchase order for the CenturyLink Communications, LLC fiber relocation and that the City Administrator be authorized to approve change orders not to exceed the contingency amount;

 

RESOLVED, That these purchase order amounts may be expended without regard to fiscal year; and

 

RESOLVED, That the City Administrator be authorized to take necessary administrative actions to implement this resolution, including signing any additional documents required for completion of the work.
