Resolution to Approve a Contract with Best Asphalt to Rebuild the Tennis and Basketball Courts at Clinton Park ($133,843.00)

Attached for your review and action is a resolution to approve a $133,843.00 contract with Best Asphalt to rebuild the tennis and basketball courts at Clinton Park.
The City has been making improvements to existing tennis and basketball courts that are in disrepair. The Clinton Park courts were first constructed in 1966 and were repaved in 1987 to repair cracks. The court surface has multiple cracks, and the base is in disrepair and requires a complete rebuild. Additionally, the courts were undersized when they were originally constructed, and this improvement will bring the tennis courts to regulation size with adequate safety buffers.
Two neighborhood public meetings were held in September 2012 to discuss the improvements. Additionally, the Park and Recreation Open Space Plan notes these Clinton Park improvements as an action plan item for 2013. In 2013, the project was sent out for bid, but only one construction company bid on the project, so the decision was made not to award a contract. At that time there was not enough time to rebid the project and get it built in 2013. Hence, it was rebid in January, 2014, with anticipated construction in Spring/Summer of 2014.
Five bids were received by the City for this project in response to ITB 4317:

Staff is recommending awarding a contract to Best Asphalt in the amount of $133,843.00 for improvements to Clinton Park. A 10% construction contingency ($13,384.00) is requested to cover potential contract change orders to be approved by the City Administrator. It is requested that a $147,227.00 contract and contingency amount be approved for the life of the project without regard to fiscal year. Funding is available in the approved FY2014 Park Maintenance and Capital Improvement Millage budget.
The Park Advisory Commission recommended approval of this contract at their February 18, 2014 meeting.
Best Asphalt meets the living wage and prevailing wage requirements and received Human Rights approval on January 29, 2014.

Whereas, The Clinton Park tennis and basketball courts are in disrepair and in need of major renovation,
Whereas, The Parks and Recreation Open Space Plan recommended these infrastructure improvements in 2013;
Whereas, The Park Advisory Commission recommended approval of this contract at their February 18, 2014 meeting;
Whereas, Competitive bids were received by Purchasing in response to ITB 4317 on January 23, 2014;
Whereas, Best Asphalt submitted the lowest responsive bid; and
Whereas, Best Asphalt received Human Rights approval on January 29, 2014;
RESOLVED, That City Council approve a contract in the amount of $133,843.00 with Best Asphalt to rebuild the tennis and basketball courts at Clinton Park and approve a construction contingency of $13,384.00 (10%) to cover potential contract change orders with funds to be available for the expenditure during the life of the project without regard to fiscal year;
RESOLVED, That the City Administrator be authorized to take all necessary administrative actions to implement this resolution including the authority to approve change orders within the approved contingency; and
RESOLVED, That the Mayor and City Clerk be authorized and directed to execute the contract after approval as to substance by the City Administrator and approval as to form by the City Attorney.
