Title

An Ordinance to Amend Section 5.28.4 of Chapter 55 (Unified Development Code) of Title V (Community Participation Requirements) CPC Recommendation: Approval as Amended (8 Yes, 0 No) (ORD-26-02)

Memorandum

Following adoption of Ordinance 25-24 (Public Notices and Hearings), Ordinance 25-25 (Citizen Participation) on July 21, 2025, fewer development activities require a public hearing and thus fewer mailed, published, and posted notices will be available to the community. As a result, additional information and notice via signage placed on a proposed project site is recommended. Staff presented research on the notice provisions from other communities to the Ordinance Revisions Committee at its July 22, 2025 meeting. Staff also provided draft ordinance changes and a draft sign template and guidelines at the September 25, 2025 Ordinance Revisions Committee (ORC) meeting. 

 

The proposed concepts below address the feedback received from the two ORC meetings to require all projects appearing before the Planning Commission to provide on-site signage at early stages of the review and approval process. This feedback included adding standards for sign placement, required content, timing, and materials to the UDC. Further standards are included in the guidelines and template provided by the Planning and Development Services Unit (PDSU).

 

Amendments for the following changes were presented to the Planning Commission on December 2, 2025:

 

                     Posting requirement

                     Petitioners must install a durable, all-weather sign on all property frontages using PDSU-provided guidelines and templates.

 

                     Required Content

Signs must include:

                     File number(s)

                     Main address, petitioner's name and point of contact

                     Project name (if applicable)

                     Site description: all addresses and current zoning designation

                     Project description in text and graphics: proposed use, development activity, zoning, and petitions included with the application

                     Community participation meeting information (Type 1 projects only)

 

                     Posting Deadlines

                     Type 1 Projects: projects requiring public hearing by Planning Commission or projects determined as Type 1 by the Planning Manager.

                     Post: 15 days before community participation meeting

                     Remove: Within 15 days after building permit issuance, application denial, or withdrawal

 

                     Type 2 Projects: projects approved by the Planning Commission without public hearing.

                     Post: Within 15 days after PDSU accepts application for review

                     Remove: Within 15 days after building permit issuance, application denial, or withdrawal

 

At the December 2, 2025, Planning Commission meeting, there was discussion around requiring all site plans to comply with the Community Participation signage amendments, in addition to site plans for Planning Commission approval. This change would require another amendment to Section 5.28.4, thus requiring another notice and public hearing. Community Participation signs will be exempt from Section 5.24 Signs in the Unified Development Code (proposed amendments forthcoming).

 

The attached ordinance was recommended for approval by the Planning Commission after the public hearing and discussion on December 2, 2025. The ordinance will take effect on July 1, 2026.
