Memorandum

Attached for your review and approval is a resolution to establish the estimated cost and distribution of costs for the proposed new sidewalk and curb and gutter to be constructed as part of the Miller Maple Sidewalk Project (Sidewalk District #48). In accordance with the City’s Non-Motorized Plan and Complete Streets approach, it is proposed to install a new sidewalk to close gaps and provide a continuous pedestrian connection along the north and south sides of Miller Avenue between Kuehnle Avenue and North Maple Road, and along the west side of North Maple Road from Miller Avenue to approximately 800 feet north, across the Maple Cove Apartments development.  Also included is the replacement of the deteriorated asphalt sidewalk on the south side of Miller Avenue and construction of Rectangular Rapid Flashing Beacons (RRFBs) at the crossings of Maple and Miller at the Maple Cove Apartments and Kuehnle Avenue, respectively.

 

Budget/Fiscal Impact

Estimated Project Costs are as follows:

As called for in Chapter 13 of City Code, the cost for the addition of new sidewalk where none currently exists is borne by the parcels that benefit from the improvements. Federal Surface Transportation Funds will pay for up to $257,000.00 of the project costs. The remaining costs ($405,350.00) will be local share and will be paid for by a combination of special assessments, IT funds (for conduit installation), General Fund, and Street Bridge, and Sidewalk Millage funds.

The City’s ability to use federal funds for this project has created the opportunity for the adjacent property owners to receive the sidewalk and curb improvements at a lower cost and to reduce the City’s share for the project.

 

Maintenance Impact

Routine maintenance, such as snow clearing, will be the responsibility of the adjacent property owners. Long-term repairs and/or replacement of sidewalk slabs adjacent to taxable parcels will be performed by the City through the Street, Bridge, and Sidewalk Millage.

 

Public Engagement

On December 5, 2016, City Council approved Resolution 1 authorizing staff to undertake this work as a special assessment project. An administrative hearing was held on January 24, 2017 at Abbot Elementary to discuss the project and the special assessment process and costs.  Of the 14 property owners invited, 8 attended.  The majority of the property owners in attendance fronted on North Maple Road, and were generally opposed to the project. All expressed concern with the payback time of the assessment, and requested additional time and smaller installments.

 

Based on the feedback from the public, the limits of the project along the North Maple Road leg of the project were reassessed. Based on resident opposition, and the fact that the new sidewalk would not be able to continue north under the M-14 overpass, the project limits were changed to extend only as far as the Maple Cove apartments property.  A mid-block crosswalk was also added to the project scope to provide a safe crossing of North Maple Road at the north end of the proposed sidewalk.

 

The special assessment amounts will be distributed to the properties in proportion to the length of sidewalk, curb, and gutter that will be installed fronting each property.

Body

Whereas, Plans and specifications have been prepared for the Miller Maple Sidewalk Project (Special Assessment District #48);

 

Whereas, In accordance with Chapter 13 of City Code, the cost for the addition of new sidewalk is borne by the benefitting parcels;

 

Whereas, A construction estimate and appropriate funding sources have been established; and

 

Whereas, Federal Surface Transportation Funds are available to fund a portion of the construction costs;

 

RESOLVED, That the City Council determine the cost of said sidewalk improvement, including all incidentals, to be $662,350.00, and that of said cost, the sum of $405,350.00 be a local share;

 

RESOLVED, That, of the local share, $56,550.00 be paid by special assessment upon the properties specially benefited;

 

RESOLVED, That the Street, Bridge, and Sidewalk Millage Capital Budget be increased by $50,000.00 with the source of funding being a transfer from the existing Project Management General Fund Operations and Maintenance Budget;

 

RESOLVED, That the following described lots and parcels of land be designated as constituting the special assessment district against which the cost of said improvement shall be assessed, or against which an improvement charge shall, pursuant to Section 1.278 of the City Code, be levied; and (SEE ATTACHED)

 

RESOLVED, That the City Assessor be hereby directed to prepare a special assessment roll in accordance with the foregoing determinations of the City Council and to file the same, together with his certificate attached thereto, with the City Clerk for presentation to the City Council.
