Resolution to Approve Change Order No. 5 with Doan Construction Co. for the 2018 Annual Sidewalk Program Project and Appropriate $50,778.06 (8 Votes Required)

Memorandum

Attached for your review and approval is a change order to the Construction Contract with Doan Construction Co. (Bid No. 4522) for the 2018 Annual Sidewalk Program Project.

 

The Project consisted of repair or maintenance of sidewalks in approximately 20% of the City in 2018, as part of a 5-year program to maintain and repair the City’s sidewalk system. The Project also includes the continued replacement of sidewalk-curb ramps to meet accessibility requirements at requested locations throughout the City.  The attached map depicts the areas repaired and maintained in 2018.

 

During construction, it became clear that the final area to be maintained in the 2018 areas (Area 2018-02, in the downtown area) could not be completed without expending more than the original Contract Amount ($1,057,320.54).  Contract Change Orders 1-4 ($94,107.53) were within the Contract’s contingency of $100,000.00 and approved administratively. Contract Change Order 5 ($50,778.06) will bring the total Contract to $1,202,206.13.

 

Doan Construction Co. complies with the City’s Non-Discrimination and Living Wage Ordinances.

 

Budget Impact

Funding for the Project comes primarily from the Street, Bridge, and Sidewalk Millage; with some additional funding from the Major and Local Street Funds, County Street Millage, Michigan Department of Transportation, the University of Michigan, Downtown Development Authority, and various departmental budgets within the City of Ann Arbor, depending on the location at which the work is done. The work that was completed under change order No. 5 is associated with work funded via the Street, Bridge, and Sidewalk Millage, which has funding available in the existing available fund balance.

Whereas, The City of Ann Arbor FY18 Capital Improvements Plan (CIP) includes the 2018 Annual Sidewalk Program Project;

 

Whereas, It was necessary to maintain and repair approximately 20% of the City’s pedestrian facilities in 2018;

 

Whereas, It was necessary to increase of the amount maintenance and repair to pedestrian facilities to keep the sidewalks in the 2018 Areas in safe condition for the travelling public;

 

Whereas, Funds are available in the existing Street, Bridge, and Sidewalk Millage Fund Balance;

 

Whereas, Doan Construction Co. was awarded a construction contract for the 2018 Annual Sidewalk Program Project in the amount of $1,057,320.54;

 

Whereas, The existing contingency in the amount of $100,000.00 is insufficient to cover the addition of Change Order No. 5; and

 

Whereas, Doan Construction Co. complies with the City’s Non-Discrimination and Living Wage Ordinances.

 

RESOLVED, That Change Order No. 5 to the construction contract with Doan Construction Co. for the 2018 Annual Sidewalk Program Project be approved in the amount of $50,778.06 for additional amounts of work under that contract;

 

RESOLVED, That $50,778.06 be appropriated from the Street, Bridge, and Sidewalk Millage Fund Balance for purposes of funding Change Order No. 5 ; and

 

RESOLVED, That the City Administrator be authorized to take the necessary administrative actions to implement this resolution.
