Memorandum
This easement is given as part of the 2026 Sidewalk Gap Elimination Project and amends the easement previously approved by City Council on December 1, 2025, in R-25-424, recorded in Liber 5611, page 489, Washtenaw County Records. This amended easement is granted voluntarily by the property owners to avoid removal and damage to a tree in the right of way.

Whereas, Karen G. Richard and Barbara Jo Smith, joint tenants with full rights of survivorship, are the owners of property commonly known as 3035 Brockman Blvd, Ann Arbor MI 48104; and
Whereas, Karen G. Richard and Barbara Jo Smith have signed an amended grant of easement for public sidewalk as shown and described on the attached map:
A SIDEWALK EASEMENT FOR INGRESS-EGRESS PURPOSES, BEING PART OF LOT 13, EASTOVER HILLS SUBDIVISION, AS RECORDED IN LIBER 3, PAGE 5 WASHTENAW COUNTY RECORD OF PLATS, LOCATED IN THE NORTHEAST 1/4 OF SECTION 04, TOWN 3 SOUTH, RANGE 6 EAST, CITY OF ANN ARBOR, WASHTENAW COUNTY, MICHIGAN, MORE PARTICULARLY DESCRIBED AS FOLLOWS:
COMMENCING FROM THE NORTHEAST CORNER OF LOT 13 OF SAID SUBDIVISION; THENCE S03°05'14"E 2.64 FEET ALONG THE EAST LINE OF SAID LOT 13 TO THE SOUTH RIGHT-OF-WAY LINE OF BROCKMAN BOULEVARD (WIDTH VARIES - PUBLIC) AND THE POINT OF BEGINNING; THENCE CONTINUING S03°05'14"E 6.84 FEET ALONG THE EAST LINE OF LOT 13; THENCE S61°10'36"W 23.31 FEET; THENCE S06°51'48"W 7.80 FEET; THENCE S63°54'50"W 13.14 FEET; THENCE N54°34'32"W 16.44 FEET TO SAID SOUTH RIGHT-OF-WAY LINE OF BROCKMAN BOULEVARD AND THE START OF A CURVE TO THE LEFT WITH A RADIUS OF 252.47 FEET; THENCE ALONG SAID CURVE 51.28 FEET WITH A CHORD BEARING AND DISTANCE OF N64°27'52"E 51.19 FEET TO THE POINT OF BEGINNING.
CONTAINING 0.009 ACRES (418 SQUARE FEET), MORE OR LESS.
RESOLVED, That the City of Ann Arbor hereby accepts this grant of easement.
