Memorandum
This memorandum and resolution requests approval to award a purchase order to Hach Company for the purchase of two water quality monitoring instrument panels.  This project originated as a recommendation from Vulnerability Assessment for the water system that was mandated by the Bioterrorism Act of 2002 post 9/11.  This project entails adding water quality monitoring devices at strategic locations throughout the water distribution system to monitor water quality and help identify potential distribution system water quality events.  The water quality monitoring component will allow the Water Treatment plant the ability to detect variations in water quality that might indicate an imminent problem, and provide Water Utility staff time to address the problem before impacting customers.  While a number of locations were identified for placement of water quality monitoring devices, this project will pilot two of those locations.  Upon installation of the water quality monitors and evaluation of the data from those monitors, the City will determine if this pilot system should be expanded to the remaining locations.
 
In 2007 the City completed a Distribution System Water Quality Monitoring Study that included recommendations for locating water quality monitors throughout the distribution system as well as recommendations for the types of monitors to be used.  The site location evaluation was completed in partnership with the United States Environmental Protection Agency (USEPA) through their Threat Ensemble Vulnerability Assessment (TEVA) program.  In addition, the Water Treatment Plant piloted several monitors from several manufacturers as part of this study.  This study recommended using the Water Quality Monitoring Panel manufactured by the Hach Company, as it was the only panel that included all of the recommended devices.
 
You also are requested to approve a contingency in the amount of $5,000.00 for the Hach Company for change orders to be approved by the City Administrator.
 
Hach Company received Human Rights approval on May 5, 2010, and complies with the living wage ordinance.
 
The funds for this project were approved as a part of the FY10 Capital Budget process.

Whereas, Monitoring water quality in the distribution system was a recommendation from the Vulnerability Assessment mandated for drinking water utilities by the Bioterrorism Act of 2002;
 
Whereas, Monitoring water quality in the distribution system provides the Water Treatment Plant with the ability to detect variations in water quality that might indicate an imminent problem, and allows Water Utility staff time to address the problem before impacting customers;
 
Whereas, The Hach Company is the only provider of a water quality monitoring panel that includes all of the instruments recommended for use by the 2007 Water Quality Monitoring Study which is the basis for this project;
 
Whereas, Funding for this project is included in FY 2010 approved Water System Capital Budget; and
 
Whereas, The Hach Company has received Human Rights approval on May 5, 2010, and complies with the Living Wage Ordinance;
 
RESOLVED, That Council accepts the proposal and awards a purchase order to the Hach Company in the amount of $54,848.20 for two Water Quality Monitoring Instrument Panels and associated services included in their proposal;
 
RESOLVED, That a contingency in the amount of $5,000.00 is approved to finance change orders to the contract with the Hach Company to be approved by the City Administrator;
 
RESOLVED, That the City make the following declaration for the purpose of complying with the reimbursement rules of Treasury Regulations 1.150-2 pursuant to the Internal Revenue Code of 1986, as amended, that the city reasonably expects to reimburse itself for expenditures for the costs of the Project with proceeds of Bonds;
 
RESOLVED, That the Mayor and City Clerk be authorized and directed to execute the contract for services after approval as to substance by the City Administrator and approval as to form by the City Attorney; and
 
RESOLVED, That the City Administrator be authorized to take the necessary administrative actions to implement this resolution.
