Resolution to Approve the First Amendment to The 616 E. Washington Development Agreement (616 E. Washington Street)
Memorandum
This resolution will approve two changes to the 616 E. Washington Development Agreement between the City of Ann Arbor and LMP Ann Arbor Property Owner, LLC, the current owner of the property, assigned interest in the development by previous owner Cerca Trova.
The proposed changes are:
To replace paragraph P-23 with new language that reduces the minimum rated capacity of installed solar panels from 90,000 kWh per year to 79,000 kWh per year. As construction plans have been refined to meet all building codes, there is not sufficient space on the roof to provide enough solar panels to meet the minimum required kilowatts per hour per year.
To eliminate paragraph P-25 which requires contracting 15 parking spaces in the public parking system. These spaces are in addition to those provided on-site and were required to meet the minimum number of off-street parking spaces required by code. There is no longer a minimum off-street vehicle parking requirement.
The 616 E. Washington development is a 19-story apartment building with ground floor retail space and parking on the second and third floors. It utilized premium options for bonus floor area (combining the residential and affordable housing options) and planned project modifications to increase building height and exceed the front setback exception in exchange meeting LEED Silver certification. Both the premium option and the planned project modifications have since been rescinded and are no longer offered in the Unified Development Code.

Whereas, The Developer has been assigned interest in the Development Agreement for land which has received site plan approval as 616 East Washington Planned Project Site Plan, approved on December 2, 2022 and administratively amended on February 4, 2022; and
Whereas, The City and Development have agreed in principle to the attached amendment to the Development Agreement;
RESOLVED, That City Council approves this amendment to The 616 E. Washington Development Agreement that was originally entered on February 9, 2022, as attached; and
RESOLVED, That the Mayor and City Clerk are authorized and directed to sign the amendment after approval as to substance by the City Administrator and approval as to form by the City Attorney.
