Attached for your review and consideration for approval is a resolution authorizing Professional Services Agreements with ROWE Professional Services Co. for $37,549.00 for engineering design work for the Morehead - Delaware Pedestrian Bridge Project.
When the Lansdowne No. 3 subdivision was built in the 1960s and 70s, the developer installed three weirs across the drain and retention basins that lie between the properties on Morehead Court and Delaware Drive east of South Seventh Street and are part of the Northwest Branch of Malletts Creek. The developer created Lans Basin, Inc., whose members are the owners of those properties. Lans Basin, Inc., is responsible for the maintenance of the drain and retention basins, including the weirs. A simple wooden bridge was built on one of the weirs over the Malletts Creek. The plat for Lansdowne No. 3 established pedestrian pathways between homes on both Morehead Court and Delaware Drive and providing pedestrian access to the bridge from the sidewalks along those streets. The pedestrian bridge was removed in 2010 due to safety concerns associated with the weir upon which it sat.
Replacement of the bridge could not be considered until Lans Basin, Inc. addressed repair and replacement of the weir. The City also indicated that, to avoid a similar situation in the future, the weir would need to be relocated away from its original position so that the new bridge could rest on it is own superstructure. Lans Basin, Inc. reported that weir replacement was completed in 2015.
On May 18, 2015 City Council approved an amendment to the FY 16 budget allocating $450,000.00 from the General Fund for the Morehead - Delaware Pedestrian Bridge Design Project.
On January 8, 2016, a request for proposals for the Morehead - Delaware Pedestrian Bridge Design Project was issued (RFP-961), and proposals from four consultants were received on January 28, 2016. A team of staff members reviewed the proposals and selected ROWE Professional Services Co. based on their professional qualifications, past involvement with similar projects, proposed work plan and fee quotations. ROWE Professional Services Co. complies with the requirements of the City’s Non-Discrimination and Living Wage ordinances.
Budget/Fiscal Impact
This project is included in the Capital Improvement Plan (CIP) as: “Morehead - Delaware Pedestrian Bridge” (R-AT-16-05), and is included in the approved FY 16 General Fund budget as amended by City Council. The project requires additional staff effort that was not initially accounted for prior to the May 18, 2015 budget amendment; however resources have been shifted around to accommodate the work as required.

Whereas, Lans Basin, Inc. reported that weir replacement was completed in 2015, allowing for the replacement of the bridge to be considered;
Whereas, The Morehead - Delaware Pedestrian Bridge Project is included in the City’s Capital Improvements Plan (R-AT-16-05);
Whereas, City Council approved an amendment to the FY 16 budget on May 18, 2015, allocating $450,000.00 from the General Fund for the Morehead - Delaware Pedestrian Bridge Design Project;
Whereas, It is necessary to retain the services of a professional engineering firm to perform the project design;
Whereas, In response to RFP No. 961 for the Morehead - Delaware Pedestrian Bridge Design Project, the City received four proposals and selected ROWE Professional Services Co. based on their professional qualifications, past involvement with similar projects, proposed work plan and fee quotations; and
Whereas, ROWE Professional Services Co. complies with the requirements of the City’s Non-Discrimination and Living Wage ordinances;
RESOLVED, That the City Council approve the Professional Services Agreement with ROWE Professional Services Co. in the amount of $37,549.00 for engineering design work for the Morehead - Delaware Pedestrian Bridge Project;
RESOLVED, That a contingency amount of $10,000.00 be established from the project budget and that the City Administrator be authorized to approve change orders to the professional services agreement with ROWE Professional Services Co., not to exceed $10,000.00 in order to satisfactorily complete the project;
RESOLVED, That the Mayor and City Clerk be authorized and directed to execute said agreements after approval as to form by the City Attorney and approval as to substance by the City Administrator; and
RESOLVED, That the City Administrator be authorized to take the necessary administrative actions to implement this resolution.
