Memorandum
Your approval of the attached resolution to supply sanitary sewer service outside City limits to 1643 S. State Street in Ann Arbor Township is requested.  The property owner filled for annexation of 1643 S. State Street in May 2011, along with the adjacently-owned parcel located at 1645 S. State (presently used for storage and not asking for utility service at this time).  This is a non-residentially-zoned property that is located within the envisioned future City limits.
In 1937, the city approved the then-owner's application for city water (see attached) and the property is active for city water service.  In 1985 the city reconstructed water main for which an improvement charge was due.  We are unable to locate a water agreement for that water service, nor find record of payment of the water improvement charge.  Therefore, we requested the owner submit both water and sanitary sewer agreements.  The water, sanitary sewer, and sidewalk improvement charges for this property were paid in full, along with the $40 fee per outside city service agreement to cover the costs for recording the documents at the Washtenaw County Register of Deeds.  Additionally, the sidewalk improvement charge for the adjacent property of 1645 S. State Street was paid in full.
The resolution before you today requests permission for 1643 S. State to connect to city sanitary sewer.  We also request authorization to sign the current water service agreement by virtue of the 1937 permission.
No storm water from this property's roof downspouts, drains, or other sources will be allowed to be connected to our sanitary sewer system.  We will tap into our unrestricted bank of footing drain disconnect credits to mitigate this new flow.  It is beneficial to the City to remove this non-performing or under-performing septic system.  The City's sewer system has the available capacity and is the only system that can practically and reasonably furnish this service.

Whereas, The Stefan Hofmann Revocable Living Trust owns real property located at 1643 S. State Street and Stefan Hofmann, Trustee, requests that the City extend public sewer service to the property in Ann Arbor Township;
 
Whereas, As a result of 1937 Council action the property has approval for its current water service;
 
Whereas, Stefan Hofmann, Trustee, desires to enter into an agreement with the City to provide an equitable method of obtaining City services outside of its corporate boundaries;
Whereas, On June 6, 2011, Stefan Hofmann, Trustee, petitioned to annex the property to the City of Ann Arbor;
Whereas, The City will tap into our unrestricted bank of footing drain disconnect credits to mitigate this new flow;

Whereas, The City has received payment in full for the water, sanitary sewer, and sidewalk improvement charges for 1643 S. State Street in the amount of $14,751.72;
 
RESOLVED, That the Mayor and Clerk are authorized and requested to sign the water agreement resulting from the 1937 City Council action that the property be approved to receive City water services to the land during the time it is still outside of the Corporate City Limits;
RESOLVED, That the Mayor and Clerk are authorized and requested to sign the sanitary sewer agreement to allow City sanitary sewer service to the land during the time it is still outside of the Corporate City Limits;
RESOLVED, That the City Administrator is authorized to take any other necessary administrative actions to implement this resolution; and
RESOLVED, That the Public Services Area promptly record the executed agreements in the office of the Register of Deeds of Washtenaw County, Michigan, and send an approved copy of the resolution and a executed copy of the agreements to the owner.
