Memorandum
On November 15, 2010, Ann Arbor City Council approved acceptance of a Federal Emergency Management Administration (FEMA) Grant to purchase the property at 215 and 219 West Kingsley Street, demolish the structure at 219 West Kingsley Street, and deed restrict the property as open space.  The City intends to install a rain garden at the site as a separate project from the FEMA grant.  The property purchase process is currently underway.  Demolition of the existing structure is expected to take place by the fall of 2011.  Conservation Design Forum will be utilized to develop the grading plan that will be used by the demolition contractor, so it is desirable to enter into this contract at this time to enable this plan preparation to be performed.  Rain garden construction will follow the demolition.
 
Your approval is requested to authorize a Professional Services Agreement with Conservation Design Forum (CDF), in the amount of $25,440.00 for Design, Construction and Management Services for the Rain Garden Project at 215 and 219 West Kingsley Street.  The purpose of this rain garden is to reduce flooding in the area by increasing both flood storage capacity and the potential for stormwater infiltration.
 
The project site is in the floodway of Allen Creek, only 2,250 feet upstream of its outlet into the Huron River.  The Allen Creek creekshed contains 84% of the City's total number of floodplain structures and 87% of the City's residential floodplain. The corner of North First and West Kingsley Streets, in front of 219 West Kingsley Street, is a local low spot within the Allen Creek floodplain and is one of the first areas to flood in the entire system.  The installation of a rain garden at the site will provide additional storage capacity and will help to reduce the frequency of street flooding at this corner.
 
In April 2011, the Systems Planning Unit issued a Request for Proposals (RFP-796) for Design, Construction and Management Services for the Rain Garden Project at 215 & 219 West Kingsley Street.  Two proposals were submitted by interested firms.  A selection committee comprised of City staff from Systems Planning and Natural Area Preservation reviewed and evaluated the submitted proposals.  The selection committee chose CDF for this project based on their proposal, project organization, and past experience by the firm and project staff, particularly with Low Impact Development (LID) Best Management Practices (BMPs) for stormwater infiltration.
 
CDF will prepare grading and planting plans for the project. CDF's sub-consultant, PlantWise, will install the rain garden and take on maintenance responsibility for 3 years following the completion of the installation.
 
CDF received Human Rights and Living Wage approval on May 17, 2011.  All personnel involved with this project will receive a "living" wage.  The form of agreement with CDF is the standard Professional Services Agreement, with the addition of a labor and material bond and a performance bond, as drafted by the City Attorney.

Whereas, Providing flood storage capacity and reducing flood risks are recognized interests of the City;
 
Whereas, Proposals were received by procurement and evaluated by City staff on the basis of qualifications, past involvement with similar projects, and proposed work plan;
 
Whereas, Conservation Design Forum, is recommended to provide Design, Construction and Management Services for the Rain Garden Project at 215 & 219 West Kingsley Street because of their extensive experience with similar projects in Ann Arbor and other municipalities, and their staff's professional and technical knowledge;
 
Whereas, Conservation Design Forum has received human rights approval on May 17, 2011; and
 
Whereas, The required funds for design, construction and management services are available in the approved Stormwater Capital Budget.
 
RESOLVED, That a Professional Services Agreement with Conservation Design Forum in the amount of $25,440.00 be approved for Design, Construction and Management Services for the Rain Garden Project at 215 & 219 West Kingsley Street to be expended without regard to fiscal year;
 
RESOLVED, That a contingency amount of $2,500.00 be established within the project budget and the City Administrator be authorized to approve additional Amendments to the Professional Services Agreement with Conservation Design Forum not to exceed $2,500.00 in order to satisfactorily complete the project;
 
RESOLVED, That the Mayor and City Clerk be authorized and directed to execute said agreement following approval as to substance by the Public Services Administrator and the City Administrator, and approval as to form by the City Attorney; and
 
RESOLVED, That City Council authorizes the City Administrator to take necessary administrative actions to implement this resolution and approve change orders with contingency funds.
