Resolution Approving an Amendment to the Employment Agreement between William R. Wheeler and the City of Ann Arbor
Memorandum
The City approved an employment agreement with William Wheeler in March, 2010 to continue his services as the Municipal Center Project Manager. The contract was structured to expire when Mr. Wheeler hit a maximum compensation of $126,000.00 or by April 30, 2011. Unfortunately, the renovation of the Larcom building has taken longer than originally expected as a result of the basement flood and other unanticipated conditions that can be found during renovation projects. His services provide a significant value to the contract and allow staff to focus on their other City obligations as the project finishes up.
Your approval is requested to extend Mr. Wheeler's contract 60 days until June 30, 2011. No change in compensation from the original contract is requested as we are below the original maximum compensation approved. Mr. Wheeler has been judicious with his hours worked and also took a compensation cut on July 1, 2010 in line with other non-union staff, as provided for in his contract.

Whereas, William R. Wheeler has served as the Project Manager for the City of Ann Arbor Municipal Center Project since its inception;
Whereas, The City entered into an Employment Agreement with William R. Wheeler on March 15, 2010 to provide services as Project Manager for the Ann Arbor Municipal Center Project;
Whereas, The Employment Agreement with Mr. Wheeler expires on April 30, 2011;
Whereas, The City desires to extend Mr. Wheeler's employment until June 30, 2011, with no increase in the maximum compensation provided for in the original Employment Agreement;
Whereas, Funding is available in the approved Municipal Center Project Budget;
RESOLVED, That the City Council approve the amendment to the employment agreement with William R. Wheeler to extend the term of the agreement with no change in the maximum compensation of $126,000.00;
RESOLVED, That the Mayor and City Clerk be authorized and directed to execute said amendment with William R. Wheeler after approval as to form by the City Attorney and approval as to substance by the City Administrator;
RESOLVED, That the City Administrator be authorized to take the necessary actions to implement this resolution; and
RESOLVED, That the agreement with William R. Wheeler be funded from the approved Municipal Center Project Capital Budget.
