Resolution to Finalize the Agreement with DTE Energy for the Relocation of Existing Overhead Power Lines for the E. Stadium Boulevard Bridges Replacement Project ($377,966.20)

Attached, please find a resolution that will approve a purchase order in the final amount of $377,966.20 with DTE Energy, Inc. (DTE) for the overhead power line relocation work associated with the subject project.
On October 19, 2009 the Public Services Area came before you and requested authorization for the City Administrator to enter into an agreement with DTE to relocate existing sub-transmission and distribution power lines pursuant to the East Stadium Boulevard Bridges Replacement Project (R-09-423, copy attached.) The resolution established a not-to-exceed figure of $340,000.00 for the purchase order. The preliminary cost of the power line relocation for the lines over E. Stadium Boulevard was $302,944.00. That cost did not provide for relocation of power lines that fed the University's Golf Course because DTE had not selected a route nor obtained easements for the lines.
The final cost of this work has now been determined. It is expected that DTE will finalize all work in May, 2011. The balance of costs due DTE is $37,966.20. The total cost for all work performed pursuant to the relocation of overhead power lines associated with this project is $377,966.20.
Funding for this work will come from the approved FY11 Street Repair Millage Capital Budget and is considered local match for State and Federal Funds for the project.

Whereas, It is necessary to temporarily relocate DTE Energy, Inc. power lines so that the E. Stadium Boulevard Bridge over the Ann Arbor Railroad tracks can be safely removed and replaced;
Whereas, The project schedule did not allow for the agreement between DTE Energy, Inc. and the City of Ann Arbor to be finalized and presented for Council's review and approval without adversely impacting the project's schedule;
Whereas, Resolution R-09-423 stipulated that the final agreement and its cost would be brought before City Council for its retroactive approval and approved a purchase order in the not-to-exceed amount of $340,000.00 for the work;
Whereas, The final cost of the work has been determined to be $377,966.20 which results in a need to increase the final value of the agreement with DTE Energy, Inc. in the amount of $37,966.20;
Whereas, The agreement with DTE Energy, Inc. has remained unchanged with only the final value of the work increasing; and
Whereas, The Public Services Area is now bringing to City Council for its review and approval the final costs of the work performed by DTE Energy, Inc. pursuant to the subject project.
RESOLVED, That Council approve a purchase order in the total amount of $377,966.20 with DTE Energy, Inc. for the needed relocation of power lines and appurtenances for the E. Stadium Boulevard Bridges Replacement Project;
RESOLVED, That the funding for the work will come from the approved FY11 Street Repair Millage Capital Budget; and
RESOLVED, The City Administrator be authorized and directed to take the necessary administrative actions to implement this resolution.
