Attached for your review and approval please find a resolution that awards a construction contract to Eagle Excavation, Inc. in the amount of $ 448,131.00 for the S. Fifth Avenue and Vaughn Street Water Main Replacement Project.
The existing water mains on S. Fifth Avenue and Vaughn Street are in poor condition and undersized. This project will replace the existing 4-inch water mains with approximately 360 feet of new 12-inch Ductile Iron water main along S. Fifth Ave. from Liberty St. to Washington St. and 700 feet of new Ductile Iron water main along Vaughn Street from Packard St. to E. University Ave. Following the installation of the water main. The contractor will complete all street restoration work. A public engagement meeting for this project was held on March 9, 2011, with no attendance from the members of the public.
 
Plans and specifications were made available at several on-line construction bidding sites. Four bids were received and opened on March 10, 2011. The lowest responsible bid submitted by Eagle Excavation, Inc. in the amount of $ 448,131.00 is approximately 18% below the Engineer's Estimate. Attached is a tabulation of the bids received for the project.
 
Eagle Excavation, Inc. received Human Rights approval on March 11, 2011.  All employees of Eagle Excavation, Inc., who will work on the project, will receive compensation in accordance with the Living Wage Ordinance.

Whereas, The City of Ann Arbor Adopted Capital Budget includes the S. Fifth Avenue and Vaughn Street Water Main Replacement Project;
 
Whereas, The existing water mains on S. Fifth Avenue and Vaughn Street are in poor condition, undersized and need to be replaced;
 
Whereas, Competitive bids were received by the Office of Procurement on March 10, 2011 and Eagle Excavation, Inc. was the lowest responsible bidder with a submitted bid of $448,131.00;
 
Whereas, the contractual proposal sets forth the services to be performed by said company, and the payments to be made by the City therefore all of which are agreeable to the City;
 
Whereas, It is now necessary to enter into a contract with said company for this construction project; and
 
Whereas, Eagle Excavation, Inc. has received Human Rights approval on March 11, 2011 and its employees will receive compensation in accordance with the Living Wage Ordinance;
 
RESOLVED, That a contract in the amount of $ 448,131.00 be awarded to Eagle Excavation, Inc. for the construction of the S. Fifth Avenue and Vaughn Street Water Main Replacement Project;
 
RESOLVED, That the Mayor and City Clerk be authorized and directed to execute said contract after approval as to form by the City Attorney, and approval as to substance by the City Administrator;
 
RESOLVED, That a contingency amount of $ 45,000.00 be established within the project budget and that the City Administrator be authorized to approve additional change orders to the construction contract with Eagle Excavation, Inc., not to exceed $45,000.00  in order to satisfactorily complete this project; and
 
RESOLVED, That the City Administrator is authorized to take necessary administrative actions to implement this resolution.
