Memorandum
Attached for your review and approval is a resolution to award a construction contract to Fonson, Inc. in the amount of $159,107.31 for the AATA Washtenaw Avenue East Bound Bus Turnout. This construction project is funded entirely by the AATA, under the terms of an agreement submitted for the City Council's approval.
 
The AATA Washtenaw Avenue East Bound Bus Turnout project includes the construction of a new concrete pavement turnout approximately 11 feet wide and 175 feet in length along the south side of Washtenaw Avenue and the north side of the Washtenaw Service Drive between Pittsfield Boulevard and Yost Boulevard.  The work also includes storm sewer construction, new concrete curb and stamped decorative sidewalks and sidewalk ramp replacement.  The construction work area will be partitioned from traffic using concrete barrier wall.  The two eastbound lanes of Washtenaw Avenue will remain operational throughout the construction period.
 
In July of 2009, the agreement with the AATA which provided for a bus stop and transfer location at the Arborland shopping center was terminated by the shopping center management.  To maintain service for shopping center patrons, the AATA located bus stops at the intersection of Washtenaw Avenue and Pittsfield Boulevard as a short term solution.  In an effort to find a longer term solution, the AATA contacted the City and the Michigan Department of Transportation (MDOT) about developing a bus turnout along the south side of Washtenaw Avenue between Pittsfield Boulevard and Yost Boulevard.  Recognizing that a turnout would allow for buses to stop outside of the operating roadway and would improve traffic flow, reduce delays, and increase safety for both motorists and transit patrons, the City and the MDOT agreed that this long term solution was in their best interest, and worked together with AATA to establish the project.  AATA, in turn, contracted with Orchard, Hiltz and McCliment, Inc. (OHM) to perform the project design, which was completed in January of 2011.
 
The project location is within multiple jurisdictions along Washtenaw Avenue and the Washtenaw Avenue Service respectively under separate control of the MDOT and the City.  Acknowledging the relationship these two agencies have working together with one another, the relationship between AATA and the City, and the City's experience with road construction projects, the AATA requested that the City, under the terms of an agreement submitted earlier for the City Council's approval, oversee and manage the construction of this project including soliciting bids, selecting a contractor, and awarding the construction contract.
 
Twenty sets of plans and specifications were distributed to contractors that expressed interest in the project.  Four bids for the construction were received and opened on Tuesday, March 1, 2011.  The lowest responsible bid was submitted by Fonson, Inc. for a total of $159,107.31.
 
Fonson, Inc. received Human Rights approval on March 11, 2011.  Employees working on this project will be paid prevailing wages, which exceed the "living wage" per the contract.
 
The total project cost is estimated at $237,107.31 as shown below:

The AATA will be responsible for any and all costs associated with the project and each project component, including Construction Engineering (CE), Project Management overhead, and all other costs incurred by the City to perform the required work.
 
The construction project is expected to begin in April of 2011 and last approximately two months, weather permitting.

Whereas, The AATA Washtenaw Avenue East Bound Bus Turnout Project will provide bus stops and a transfer location for AATA buses on east bound Washtenaw Avenue;
 
Whereas, The total estimated cost to complete all work included in the AATA Washtenaw Avenue East Bound Bus Turnout Project is $237,107.31;
 
Whereas, The AATA will be providing any/all funding for the AATA Washtenaw Avenue East Bound Bus Turnout Project per the City-AATA agreement;
 
Whereas, Competitive bids were received by the City of Ann Arbor Procurement Unit on March 1, 2011 and Fonson, Inc. of Brighton, Michigan was the lowest responsible bidder at $159,107.31
 
Whereas, The contractual proposal sets forth the services to be performed by Fonson, Inc, and the payments to be made by the City for those services, all of which are agreeable to the City;
 
Whereas, It is now necessary to enter into a contract with Fonson, Inc for this construction; and
 
Whereas, Fonson, Inc received Human Rights approval on March 11, 2011 and complies with the Living Wage Ordinance;
 
RESOLVED, That a contract in the amount of $159,107.31 be awarded to Fonson, Inc. for the construction of the AATA Washtenaw Avenue East Bound Bus Turnout Project (Bid No. 4131);
 
RESOLVED, That a contingency amount of $17,500.00 be established within the project budget and that the City Administrator be authorized to approve additional change orders to the construction contract with Fonson, Inc., not to exceed $17,500.00 in order to satisfactorily complete the project;
 
RESOLVED, That the City Administrator is authorized to take necessary administrative actions to implement this project, including issuing Traffic Control Orders for the Washtenaw Service Drive from Pittsfield Boulevard to Yost Boulevard, including parking prohibition as needed in excess of one (1) block and/or ninety (90) days;
 
RESOLVED, That funding be available for the life of the project, without regard to fiscal year;
 
RESOLVED, That the Mayor and City Clerk be authorized and directed to execute this contract after approval as to form by the City Attorney, and approval as to substance by the City Administrator;
 
RESOLVED, That the City Administrator be authorized to take the necessary administrative actions to implement this resolution.
