Memorandum
We request your approval of Amendment No. 1 to the Professional Services Agreement with Malcolm Pirnie, Inc. (MPI) in the amount of $84,287.00 for professional engineering services related to design and construction of Phase 1 of the Facility Renovations Project (FRP) at the City's Wastewater Treatment Plant (WWTP).  
 
The FRP is one of two major plant renovation projects currently underway at the WWTP.  The FRP includes complete demolition and replacement of the older portion of the plant (West Plant), which has exceeded its useful life, and modifications to the East Plant to improve process reliability and to maintain our treatment capacity for current and future flows.
 
The FRP is being implemented in two phases.  Phase 1 includes demolition of the Solids Reaeration Tank and the Old Solids Storage Building, electrical modifications needed to power existing equipment during construction activities and installation of a wireless supervisory control and data acquisition system to prepare for future construction work.  Phase 2 of the FRP includes the largest part of the renovations identified in the City of Ann Arbor WWTP Facilities Master Plan.  Design for Phase 2 is essentially complete and regulatory permits are currently being obtained.  Phase 1 work necessarily preceded the second major project, which is the Residuals Handling Improvements Project (RHIP). The RHIP is currently being constructed and includes demolition and replacement of existing solids handling equipment and systems and a complete demolition of the City's sludge incinerator.  Both the FRP and the RHIP are critical to maintaining treatment and solids processing capacity at the WWTP and are sequenced to minimize construction conflicts, risks and financial impacts to the City.
 
On September 24, 2007, Council approved a contract with MPI in the amount of $544,366.00 for professional design and construction engineering services for Phase 1 of the FRP.  Council also approved a contingency of $55,634.00 for the contract.    Amendment No. 1 for Phase 1 of the FRP includes additional engineering services to address floodplain issues, install a camera monitoring system for current and future construction, address unforeseen electrical changes and provide additional project management services.  WWTP staff reviewed the level of effort in Amendment No. 1 and determined that the fee is reasonable and consistent with the scope of services provided.  Amendment No. 1 is needed to balance and close out Phase 1 of the FRP with MPI.
 
MPI received Human Rights approval on July 9, 2010, and complies with the City's living wage requirements.  The standard amendment without modifications will be used for this amendment between the City and MPI.
 
We request that you approve Amendment No. 1 in the amount of $84,287.00 with MPI to complete Phase 1 of the FRP.  Funds to finance this amendment are available in the existing contingency for the contract ($55,634.00) and in the existing capital project budget ($28,653.00).

Whereas, The FRP is a two phase project that will extend over several fiscal years, and Phase 1 of the FRP opened space needed for future construction activities;
 
Whereas, On September 24, 2007, Council approved a contract with Malcolm Pirnie, Inc. (MPI) in the amount of $544,366.00 and a contingency in the amount of $55,634.00 for professional design and construction engineering services for Phase 1 of the FRP;
 
Whereas, Amendment No. 1 with MPI in the amount of $84,287.00 is needed to balance and close out the project 1;
 
Whereas, WWTP staff reviewed the scope of professional engineering services in Amendment No. 1 and found it reasonable and appropriate;
 
Whereas, The FRP was approved by Council during the FY05 budget process and funding is available from the contract contingency ($55,634.00) and in the capital project budget ($28,653.00); and
 
Whereas, MPI received Human Rights approval on July 9, 2010 and complies with the City's living wage requirements;
 
RESOLVED, That Council approve Amendment No. 1 in the amount of $84,287.00 with MPI to complete Phase 1 of the FRP, subject to approval as to substance by the City Administrator and approval as to form by the City Attorney; and
 
RESOLVED, That the City Administrator or designee be authorized to take the necessary administrative actions to implement this resolution.
