Memorandum
At the February 25, 2011 Council Liquor License Review Committee meeting, the members recommended that a number of on-premise liquor licensed businesses be considered for non-renewal of their annual license. Prior to a final decision on the license renewal, Chapter 109 of the City Code requires that the licensee be afforded a hearing at which time they can present arguments on their behalf, confront witnesses, and possibly be represented by an attorney. The committee is recommending that City Council allow, by passage of this resolution, the committee members to serve as the Hearing Board.

Body
Whereas, Chapter 109, Section 9:79 of the City Code, provides City Council with the authority to appoint members to a Hearing Board to conduct annual liquor license renewal hearings; and
 
Whereas, The City Council Liquor License Review Committee recommends that City Council authorize the Hearing Board to be the same members as those serving on the Liquor License Review Committee, or any one of those members to be a Hearing Officer;
 
RESOLVED, That City Council hereby appoints Councilmember Derezinski to be the Hearing Officer for all future annual renewal hearings of the Council Liquor License Review Committee.
