Attached for your consideration, please find a resolution seeking to approve a Professional Services Agreement for engineering services in the amount of $88,250.00 with J. F. New and to establish a project budget of $120,000.00.In 2009, the Michigan Department of Natural Resources and Environment (MDNRE) conducted a routine inspection of the compost facility to determine compliance with the City's stormwater permit.  The MDNRE found a small pond near the northern compost pad to be in poor condition and in need of maintenance.  In addition, the MDNRE requested the City make improvements to the stormwater management system at the facility to reduce nutrient loading to the ponds and the receiving water, Swift Run Drain.  Swift Run Drain is listed on the United States Environmental Protection Agency's Section 303(d) list of impaired waters, and a Total Maximum Daily Load (TMDL) for biota (via total suspended solids) was issued for the drain in 2004.
The compost facility's drainage system is part of a larger system on nearby City properties that discharge into Swift Run Drain.  Although interconnected, the ponds and ditches on these properties have not been studied as a unified system.  The purpose of issuing this Request for Proposals is to examine the functionality and condition of the entire system and make a prioritized list of recommendations for improvements to satisfy the MDNRE's concerns and to improve the stormwater management system as a whole.
Staff received proposals from seven (7) consulting engineering firms for the requested study.  A selection committee composed of members of Field Operations and Systems Planning reviewed the submitted proposals.  Based on the proposals received, the top two consultant teams were selected for follow-up presentations and interviews.  The selection committee chose J. F. New for this project based on their proposal, project organization, past experience, project staff and their competitive fee schedule.
The proposed agreement between J. F. New and the City of Ann Arbor includes all the required engineering services to perform the study.  Funding for this project is available in the approved FY11 Solid Waste Capital Budget.
J. F. New received Human Rights and Living Wage approval on January 19, 2011 .  All personnel involved with this project will receive a "living" wage.  The form of the agreement with J. F. New is the standard Professional Services Agreement drafted by the City Attorney.

Whereas, It is now necessary to enter into an agreement with J. F. New for the engineering services associated with the project;
 
Whereas, Funding for this study is available in the approved FY11 Solid Waste Capital Budget; and
 
Whereas, J. F. New received Human Rights and Living Wage approval on January 19, 2011;
 
RESOLVED, That Council approve a Professional Services Agreement with J. F. New in the amount of $88,250.00 for the Compost Facility Stormwater Management Study to be expended without regard to fiscal year;
 
RESOLVED, That City Council authorize and establish a project budget of $120,000.00 for the Compost Facility Stormwater Management Study to be expended without regard to fiscal year;
 
RESOLVED, That the City Administrator is authorized to approve amendments to the Professional Services Agreement up to $8,800.00, in order to satisfactorily complete the project.  The funds for these change orders will come from the contingency line item of the established project budget;
 
RESOLVED, That the Mayor and City Clerk be authorized and directed to execute said agreement after approval as to form by the City Attorney and approval as to substance by the Public Services Administrator and the City Administrator; and
 
RESOLVED, The City Administrator be authorized and directed to take the necessary administrative actions to implement this resolution regardless of fiscal year.
