Resolution to Waive Review Fees for the Heritage Row PUD Zoning and Site Plan Petition

Whereas, Fifth Avenue Limited Partnership has submitted two site plan petitions and two PUD zoning and site plan petitions for the redevelopment of property at 407-437 South Fifth Ave. since 2008, and has paid over $30,000.00 to-date in review fees;
Whereas, City Council approved the City Place Site Plan for the property on September 21, 2009, and subsequently denied the Heritage Row PUD Zoning and Site Plan on June 21, 2010;
Whereas, Fifth Avenue Limited Partnership continued to explore ways to provide a PUD with a beneficial effect for the City, and has submitted a proposal to make revisions to the previous Heritage Row PUD Zoning and Site Plan in order to find a mutually beneficial solution for the developer and City that would meet the City's PUD requirements; and
Whereas, The Planning and Development Services Unit has reviewed the proposal and has indicated that additional review time for a new petition based on the proposal would be minimal because of the nature of the changes being proposed;
RESOLVED, That City Council reduces the PUD zoning and site plan petition review fees to $2000.00 for a new PUD zoning and site plan petition as proposed in correspondence from the developer, dated November 11, 2010, as long as the petition is received by the Planning and Development Services Unit within 90 days of this Resolution.
