Memorandum
Attached for your review and approval is a resolution approving and confirming an emergency purchase order with E. T. MacKenzie Company ($70,437.65) for emergency repairs to replace a sanitary sewer manhole and a storm sewer manhole located in Packard Road near its intersection with Thompson Street.
 
In the course of responding to a call to Customer Service stemming from a sewer backup at a residence on Packard Road, it was discovered that the sanitary sewer pipe had collapsed immediately outside the upstream manhole as the result of the manhole collapsing.  Due to the immediate need to repair the sanitary sewer to minimize service and traffic disruptions, and due to size of the excavation exceeding the limitations of City equipment, this work was expedited using a sole source bid and an emergency contract.
 
Additionally, due to the size of the excavation it was necessary to remove & re-install a portion of the storm sewer system.
 
The contractor selected for this emergency contract was E. T. MacKenzie Company.  The contractor had all the necessary equipment, personnel and experience to perform this work with only a few hours notice.  The contractor completed the work on a time and materials basis.  The contractor's project manager for this work has a proven track record of outstanding performance on several challenging utility projects undertaken by the city.  The final cost for completing the project is $70,437.65.
 
E. T. MacKenzie Company received human rights approval on April 29, 2010.
 
Funds are available in the FY11 Sewage Disposal System and Storm Sewer System Operating Budgets.

Whereas, Public Services staff identified a sanitary sewer manhole and pipe failure of a section of the city sewer main located near the corner of Packard Street and Thompson Street;
 
Whereas, Due to the potential for basement sewer backups in multi-family dwellings on Packard Road and University of Michigan dormitories, the work had to be performed immediately;
Whereas, The emergency repairs warrant installation of a new sanitary sewer manhole and a new storm sewer manhole;
 
 
Whereas, Funds for the contracted repairs are available in the FY11 Sewage Disposal System and Storm Sewer System Operating Budgets;
 
Whereas, E. T. MacKenzie Company was immediately available to provide repair services and agreed to the itemized time and material costs provided in their Continuing Services Contract (Resolution 09-445);
 
Whereas, E. T. MacKenzie Company has received human rights approval on April 29, 2010; and
 
Whereas, The total payment request from E. T. MacKenzie Company for the completed project was $70,437.65.  
 
RESOLVED, That the Mayor and City Council confirm and approve the emergency purchase order in the amount of $70,437.65 to E. T. MacKenzie Company for installing a new manhole in the city sewer main and a new storm manhole in the city storm main located near the intersection of Packard Street and Thompson Street;
 
RESOLVED, The completed project amount of $70,437.65 is to be financed from available funds in the approved FY11 Sewage Disposal System and Storm Sewer System Operating Budgets; and
 
RESOLVED, That City Council authorizes the City Administrator to take necessary administrative actions to implement this resolution and finalize contract actions for this project.
