Attached for your review and action is a resolution to approve a Participation Agreement with Webster Township for the purchase of development rights on the farm owned by Gilbert L. and Kathryn L. Whitney, husband and wife, located in Webster Township.
 
On February 1, 2010 City Council approved a resolution (R-10-022) to apply for Farm and Ranch Land Protection Program grant funds on the Whitney Farm and the City was subsequently awarded a grant in the amount of $418,470.  On July 6, 2010 (R-10-248) Council approved a resolution for the Purchase of Development Rights on the Whitney Farm and appropriation of funds.  At the time, a contribution had been requested from Webster Township, but no allocation of funds had been approved by the Township.  On October 19, 2010, Webster Township Board of Trustees approved a resolution and allocation of $50,000 toward the Purchase of Development Rights on the Whitney Farm.

Whereas, Chapter 42 of the Ann Arbor City Code establishes the Greenbelt District and enables the City to purchase development rights on property within the district;
 
Whereas, Chapter 42 of the Ann Arbor City Code specifically authorizes City Council to enter into agreements for joint acquisition of land in the Greenbelt District with other government agencies;
 
Whereas, Webster Township has appropriated $50,000 toward the purchase of development on the Whitney Farm; and
 
Whereas, The Greenbelt Advisory Commission recommended approval of the Participation Agreement with Webster Township for the purchase of development rights on the Whitney Farm at its November 10, 2010 meeting;
 
RESOLVED, That the Mayor and City Clerk are authorized and directed to execute the Participation Agreement defining each party's interest in the acquisition and if required, any supplemental documents necessary to document the appropriation of funds for the purchase of development rights on the Whitney Farm, after approval as to form by the City Attorney.
