Resolution to Accept Grant and Appropriate Funds from the Federal Emergency Management Agency for Purchase and Demolition at 215 & 219 W. Kingsley Street ($216,723.00) (8 Votes Required)

Attached for your review and action is a resolution to approve a grant agreement between the City of Ann Arbor and the Federal Emergency Management Agency (FEMA) to accept a Pre-Disaster Mitigation (PDM) Grant for 75% of the total project cost to (1) purchase properties at 215 & 219 W. Kingsley St., Ann Arbor (one vacant and the other with a structure); (2) conduct demolition of structure, foundation and the impervious surfaces on the sites; and, (3) grade and stabilize the site to function like a small retention area. After completion of the grant project a rain garden will be installed at the site with storm water funds that have been identified in the City's Capital Improvements Plan. Outcomes of the project include removal of one residential structure from the floodway, creation of additional flood storage, and creation of permanent open space by deed restricting the property.
In 2005, the City received a Flood Mitigation Assistance (FMA) planning grant to create a Flood Mitigation Plan. City Council approved the Flood Mitigation Plan in 2007, which made the City eligible to apply for PDM grants. In 2008, the structure at 219 Kingsley St. was determined to be a dangerous building and the owner filed a notice of voluntary interest to allow City staff to make a PDM application. This Notice is a requirement to submit the grant application but does not bind the Property Owner to sell the property.
The City submitted a PDM Grant application to the Federal Emergency Management Agency (FEMA) in December 2008, and the City was notified by letter dated September 7, 2010 that FEMA has awarded the City of Ann Arbor $216,723.00 in match dollars to fund the 215 & 219 W. Kingsley project.
Matching funds are available the City's approved FY2011 Stormwater Capital Budget. The total estimated cost of this mitigation project as well as the federal and non-federal contribution is shown below:

Total nonfederal contribution (available through the City's approved Stormwater Capital Budget: $72,241.00
Grant funds will be available for the life of the project regardless of fiscal year, and the City's Stormwater and Floodplain Management Program Coordinator will handle grant management.
If the Grant is accepted, City staff will negotiate a Purchase Agreement with the Property Owner based on the appraised fair market value of the property. The Purchase Agreement will be presented to Council for approval.

Whereas, The City of Ann Arbor completed a Flood Mitigation Plan in March 2007, recommending opening up the floodway by preventing new structures and removing existing structures from the floodway to create greenways;
Whereas, The City submitted a Pre-Disaster Mitigation Grant application to the Federal Emergency Management Agency (FEMA) in December 2008, and the City was notified by letter dated September 7, 2010 that FEMA has awarded the City of Ann Arbor $216,723.00 which represents 75% of the total project cost;
Whereas, This grant advances the attainment of reduced flood losses, minimizes damage to public and private property and protection of public health and safety by acquisition and removal of a structure in the floodway;
Whereas, Funds for the City's $72,241.00 match are available in the approved FY2011 Stormwater Fund Capital Budget, and
Whereas, The Stormwater and Floodplain Program Coordinator will handle grant management;
RESOLVED, That the City accept the Federal Emergency Management Agency grant of $216,723.00 effective November 4, 2010;
RESOLVED, That the approval of this grant application be subject to establishment of a fair market price for the property as determined by an appraisal and an approved purchase and sales agreement for the property;
RESOLVED, That the grant funds when received be appropriated to the Stormwater Capital Budget where a project budget will be set up for the life of the project, regardless of fiscal year; and
RESOLVED, That City Council authorize the Mayor, City Clerk and City Administrator to execute all documents necessary to complete the Grant requirements after approval as to form by the City Attorney.
