Resolution Confirming Washtenaw Avenue Non-Motorized Path Project Special Assessment Roll
Memorandum
Attached and recommended for approval is Resolution 4 confirming the Special Assessment Roll for the Washtenaw Avenue Non-Motorized Path Project, District No. 38, File No. 2006-030.
 
An administrative hearing explaining the project to property owners was held on December 11, 2008.  Included in the discussions were cost estimates, property assessments and the work schedule.  Resolution No. 2 establishing the estimated cost of the project, the estimated project revenue sources and the maintenance of the path and directing the preparation of the special assessment roll was approved by Council on June 21, 2010.  Resolution No. 3 scheduled the Public Hearing for September 7, 2010.  Notice of the public hearing was published August 26, 2010.
 
At the public hearing for the Washtenaw Avenue Non-Motorized Path Special Assessment Project, conducted on September 7, 2010, five individuals spoke in opposition of the Project and two letters in opposition of the Project were received by the City Clerk.
 
Per City ordinance, it is recommended that the property share payments be spread over a period of ten years.

Whereas, City Council, after due and legal notice, has met for the purpose of reviewing Special Assessment roll prepared for the purpose of assessing the private property's share of the cost of the non-motorized path described as follows:  Construction of a 10-foot wide, non-motorized asphalt path along the north/northeast side of Washtenaw Avenue between Glenwood Road and Tuomy Road.  In addition, retaining walls will be constructed to minimize grading impacts, and a sidewalk will be reconstructed from Washtenaw Avenue to Adare Circle, District No. 38, File No. 2006-030;
 
Whereas, City Council has heard all persons interested in the necessity of the improvement or aggrieved by the Special Assessment Roll and has considered any and all objections thereto; and
 
Whereas, City Council is satisfied with said Special Assessment Rolls.
 
RESOLVED, That said Non-Motorized Path Special Assessment Roll as prepared by the City Assessor be hereby confirmed in the amount of $ 1,580,000.00, and that of said total cost, the sum of $ 59,233.75, be paid by special assessment upon the property specially benefited within the City, the sum of $ 694,039.00 , be paid by the Michigan Department of Transportation Grant, the sum of $ 826,727.25 be paid by the City Alternative Transportation Fund;
 
RESOLVED, That Special Assessment Roll be divided into ten (10) installments of equal principal, the first of which shall be due on June 1, 2011, and the second installment to be due and payable on the next following June 1st; and
 
RESOLVED, That the deferred installments of said Special Assessment Roll bear interest at the rate of 5.760%, commencing June 1, 2011, said interest to be collected on the due date of the second installment of said Special Assessment Roll.
