Memorandum
There is a resolution before you to accept an easement from the United States, Administrator of General Services, which owns and manages the Federal Building, for installation of temporary tie backs under the Federal Building.  
 
Construction of the South Fifth Avenue Underground Parking Structure Project at 319 S. Fifth Avenue is currently underway.  The parking structure will extend under South Fifth Avenue. To stabilize the site during excavation approximately 78 temporary tie backs need to be installed approximately sixty feet under the north side of the Federal Building parking lot and building as part of the construction's temporary earth retention system (TERS).  Once the earth retention system is in place, the tie backs will be abandoned in place, no later than December 31, 2011.
 
In acknowledgement of US-Administrator of General Services first priority, as the landlord of the Federal Building, is to assure that the tenant population occupying the Federal Building during the Project and their respective invitees enjoy the same level of functional occupancy that currently exists prior to the construction activities including, but not limited to, safe and efficient ingress and egress to and from the Federal Building for both vehicular and pedestrian traffic, the DDA has agreed during the closure of S. Fifth Avenue, as consideration for the easement, to provide alternate access to Federal Building tenants and restoration of sidewalks and access points into the Federal Building at the completion of construction.   
 
The grant of easement and supporting agreement for use of non-federal property were negotiated by the DDA and the City Attorney's Office.   
 
Acceptance of the easement is recommended.

Whereas, The United States, by and through the Administrator of General Services ("GSA") is the legal owner of the property known in Ann Arbor, Michigan as The Federal Building, which address is 200 East Liberty, Ann Arbor Michigan 48104, Parcel ID # 09-29-404-010, which is real property located in the City of Ann Arbor, County of Washtenaw and State of Michigan;
 
Whereas, Ann Arbor City Council has authorized the Ann Arbor DDA to construct an underground parking structure at 319 South Fifth Avenue;
 
Whereas, Approximately 78 temporary tiebacks need to be installed approximately sixty feet under the north side of the Federal Building parking lot and building as part of the construction's temporary earth retention system (TERS), and once the project has been constructed these tie backs will be severed and abandoned in place;
 
Whereas, GSA has requested an easement between the GSA and the City of Ann Arbor, as owner of the property and when constructed the underground parking structure at 319 South Fifth Avenue,  to allow these tiebacks to be installed; and
 
Whereas, GSA has authorized the grant of easement to the City of Ann Arbor as described in the attached Exhibit A and A-1, which are incorporated herein and made a part hereof;
 
RESOLVED, That the City of Ann Arbor hereby accept said grant of easement.
