Memorandum
Attached for your consideration is a resolution that authorizes a one-year contract for sidewalk replacements up to $350,000.00 with Audia Construction Company for follow up efforts associated with the Annual Sidewalk Replacement Program.  The amount of the proposed contract exceeds the bid submitted by Audia Construction Company because, given the favorable pricing on the bid, staff hopes to be able to undertake more sidewalk replacements than originally anticipated.  The resolution authorizes the City Administrator to contract with Doan Construction Company, the second lowest bidder if Audia Construction Company is not able to complete the contract as needed. The resolution also authorizes an option to extend the contract with Audia Construction Company for two additional one-year periods for a total of $1,050,000.00 with the same terms and conditions subject to the annual appropriation of funds.  
 
The contract is a unit price contract for residential sidewalk replacements throughout the City.  The contract amount is based on available funds and needed replacements
 
Requests for bids were posted online and bids were received from five contractors. After evaluating the bids, staff determined that the prices were competitive and recommends Audia Construction Company to be awarded the contract.  The bid tabulation is attached.  Funding for this work is available in the approved capital budget.
 
Audia Construction Company received Human Rights approval on June 1, 2010.

Whereas, Sealed bids for Sidewalk Replacements were received in April 2010, and Audia Construction Company was the lowest responsible bidder;
 
Whereas, The Public Services Area recommends approval of a one-year contract with Audia Construction Company, with the option to extend the contract for two additional one-year periods under the same terms and conditions subject to the annual appropriation of funds;
 
Whereas, Funding for this work is budgeted is available in the approved capital budget;
 
Whereas, It is anticipated that sufficient funds will be appropriated in the FY12 and FY13 Public Services Area, Capitol Budget should the City elect to exercise its option and extend the terms of the contract; and
 
Whereas, Audia Construction Company received Living Wage and Contract Compliance approval on June 1, 2010;
 
RESOLVED, That City Council approve a contract, per Bid No. ITB - 4083, with Audia Construction Company, not to exceed $350,000.00 for one year, with the option to extend the contract for two additional one-year periods for Annual Sidewalk Replacements upon appropriation of funds in the FY12 and FY13 budgets for a total estimated amount for the three years of $1,050,000.00;
 
RESOLVED, That the City Administrator be authorized to contract with Doan Construction Co. under the same terms and conditions if Audia Construction Company is not able to complete the contract;
 
RESOLVED, That the Mayor and City Clerk be authorized and directed to execute said contract and the extensions thereof after approval as to form by the City Attorney and approval as to substance by the City Administrator; and
 
RESOLVED, That the City Administrator be authorized to take all necessary administrative actions to implement this resolution.
