Memorandum
Approval of this ordinance amendment will remove specific fee reimbursement language from the code and instead provide for fee reimbursement policies to be set by City Council as part of its fee resolutions.

The City Planning Commission, at its meeting of May 18, 2010, recommended approval of this amendment.

SUBDIVISION AND LAND USE CONTROL
REGARDING FEE REIMBURSEMENT POLICY

AN ORDINANCE TO AMEND SECTION 5:131 OF CHAPTER 57 (SUBDIVISION AND LAND USE CONTROL) OF TITLE V OF THE CODE OF THE CITY OF ANN ARBOR

The City of Ann Arbor ordains:

Section 1. That Section 5:131 of Chapter 57 of Title V of the Code of the City of Ann Arbor is amended as follows:

5:131. Fees.

An area plan, site plan, PUD site plan, plat or land division shall not be considered to have been filed with the City until all required materials are submitted and applicable fees are paid as established by resolution of the City Council upon the recommendation of the City Administrator. Reimbursements shall be offered as established by resolution of the City Council upon recommendation of the City Administrator.

(1) Reimbursements.

(a) When a petition is withdrawn, by written request, before publication of the notice of public hearing by the City Planning Commission, the community services area administrator or designee shall reimburse the petitioner the entire filing fee.
