Attached for your review and action is a resolution to approve a $44,058.00 contract with Landscape Structures, Inc., (US Communities, Contract No.040377) and a $4,406.00 (10%) construction contingency, to provide and install playground equipment at Wheeler and Bader Parks.

Each year, staff who are certified as Playground Safety Inspectors, determine which playgrounds are in need of replacement based on inspections of play areas in the park system. These determinations are based on criteria developed by the Consumer Product Safety Commission (CPSC) and the American Society for Testing and Materials (ASTM).

The playground equipment at both Wheeler and Bader were determined to be in need of replacement based on their age, condition and compliance with these guidelines. Public meetings were held to obtain input on the type of replacement equipment desired by residents.

We are utilizing the US Communities Cooperative Bid Program for this purchase. Landscape Structures, Inc submitted the lowest responsive bid under the US Communities Bids.

The resolution includes a recommended construction contingency of $4,406.00 (10%) to cover potential contract change orders to be approved by the City Administrator. It is requested that a $48,464.00 total construction project budget be established for the life of the project without regard to fiscal year.

Funding for the project is available in the approved FY 2010 Park Maintenance and Capital Improvements Millage budget.

Landscape Structures, Incorporated meets the living wage and prevailing wage requirements and received Human Rights approval May 6, 2010.
