Resolution Granting Easement for Permanent Drainage to Washtenaw County Water Resources Commissioner within West Park (8 Votes Required)
Memorandum
There is a resolution before you to grant an easement for permanent drainage to Washtenaw County Water Resources Commissioner for the maintenance of storm water controls over City lands commonly known as West Park.
The City of Ann Arbor is contracting for the installation of structural storm water controls (swirl concentrators) within West Park, as well as the integration of these controls with the existing Washtenaw County Allen Creek Drain system, to improve the storm water drainage in the Park.
The City and County have mutually agreed that the County will provide maintenance for said storm water controls in West Park as part of the Allen Creek Drain.
The easement area is designed to allow vehicular access for purposes of inspection and maintenance over the storm water control area.
This project has been reviewed and approved by the City Parks Department, which found that the easement area will not adversely affect the use and enjoyment of West Park.
The easement is in standard form and conveyed without cost to the County Water Resources Commission.
Acceptance of the easement is recommended.

Whereas, the City of Ann Arbor is the owner in fee simple of property located in the City of Ann Arbor, County of Washtenaw, State of Michigan, commonly known as West Park;
Whereas, the City of Ann Arbor and County of Washtenaw have mutually agreed that the City will install swirl concentrators for storm water control within West Park and the County will maintain said concentrators;
Whereas, to facilitate access for maintenance of said storm water controls, the County has requested a permanent easement for lands located in the City of Ann Arbor, County of Washtenaw to the City, to run with the land and burden the respective property perpetually, being more particularly described as follows:
Northerly variable width storm drainage easement "Exhibit A"
Commencing at the NW Corner of Section 29, T2S, R6E, City of Ann Arbor, Washtenaw County, Michigan; thence S 01°-31'-56" E 428.90 feet along the west line of said section; thence N 87°-54'-53" E 511.07 feet parallel to the north line of said section to the east line of North Seventh Street (66 ft. wd.) and the POINT OF BEGINNING; thence N 88°-26'-09" E 18.94 feet; thence N 45°-06'-52" E 19.94 feet; thence S 47°-29'-08" E 103.65 feet; thence S 45°-06'-49" W 95.57 feet; thence N 43°-27'-58" W 57.65 feet; thence N 01°-28'-21" W 81.09 feet and said east line of North Seventh Street to the POINT OF BEGINNING. Being a part of the NW ¼ of Section 29, T2S, R6E, City of Ann Arbor, Washtenaw County, Michigan and containing 0.20 acres of land, more or less.

Commencing at the West 1/4 Corner of Section 29, T2S, R6E, City of Ann Arbor, Washtenaw County, Michigan; thence N 01°-31'-56" W 1363.26 feet along the west line of said section; thence N 87°-27'-34" E 510.19 feet parallel to the E & W ¼ line of said section line to the east line of North Seventh Street (66 ft. wd.) and the POINT OF BEGINNING; thence N 88°-39'-20" E 94.27 feet; thence 63.43 feet along an arc of a 705.00 foot radius circular curve to the right, chord bearing N 86°-04'-42" E 63.41 feet; thence N 10°-18'-06" W 33.06 feet; thence N 79°-41'-56" E 70.00 feet; thence S 10°-18'-05" E 89.44 feet; thence S 79°-41'-56" W 70.00 feet; thence N 10°-18'-06" W 36.34 feet; thence 66.56 feet along an arc of a 725.00 foot radius curve to the right, chord bearing S 86°-01'-32" W 66.54 feet; thence S 88°-39'-20" W 94.22 feet; thence N 01°-28'-19" W 20.00 feet to the POINT OF BEGINNING. RESOLVED, That the Mayor and City Clerk be authorized to execute the grant of easement in the form approved by the City Attorney.
