Memorandum
There is a resolution before you to accept an easement for public right-of-way along the northwesterly side of Ellsworth Road from Speedway SuperAmerica LLC, a Delaware limited liability corporation, for the maintenance of public roads.

The easement is in standard form and conveyed without cost to the City.

Acceptance of the easement is recommended.

Whereas, Speedway SuperAmerica, LLC, a Delaware limited liability company, is the owner in fee simple of property located in the City of Ann Arbor, Washtenaw County, Michigan, as described in the Washtenaw County Records at Liber 3928, Page 659, recorded on February 7, 2000;

Whereas, A Secretary’s Certification, dated February 6, 2006, authorizes the delivery of a perpetual easement to the City for public right-of-way; and

Whereas, Speedway SuperAmerica, LLC, has delivered an easement to the City for public right-of-way, to run with the land and burden the respective property perpetually, being more particularly described as follows:

Being a parcel of land in the NW Quarter of the NW Quarter of Section 16, T3S, R6E, in Pittsfield Township, Washtenaw County, Michigan, bounded and described as follows:

Commencing at an iron pipe found at the NW Corner of Section 16, as per LCRC, Liber 4, Page 277, Washtenaw County Records, said point also being at the intersection of the centerlines of Ellsworth Road, so called, and South State Street, so called, and said point being the true point of beginning.

Thence N 87º 53’ 20” E along the centerline of Ellsworth Road, a distance of 386.82 feet;
Thence S 02º 06’ 40” E, a distance of 60.00 feet to a set bar;
