Memorandum
The attached ordinance adds a new Section 10:101a, Use of Cell Phone or Other Device While Operating Motor Vehicle or Bicycle Prohibited, to Chapter 126 (Traffic).  
 
This ordinance amendment prohibits the use of cell phones and other similar devices while driving a vehicle or operating a bicycle, except if the use is hands free.  The ordinance contains other exceptions to the prohibition, which are summarized as follows: use during an emergency to communicate with or obtain directions to a police department, a hospital, etc.; use by police officers, ambulance operators, etc. while on duty; and use while legally stopped and out of traffic.  All types of use are prohibited, including but not limited to texting, e-mailing, and making or receiving phone calls.
