Resolution to Approve a Cooperative Agreement between the City of Ann Arbor and the University of Michigan for the Provision of Fire Services
Memorandum
Attached is a resolution approving a Cooperative Fire Services Agreement between the City of Ann Arbor and the University of Michigan.
 
Cooperative agreement between agencies ensure that procedures are in place to maintain and insure services are in place in the event of an emergency or disaster that would necessitate immediate action to prevent the loss of life or property. Cooperative agreements also provide jurisdictional and procedural direction needed to coordinate services during both planned and unplanned events.  
 
A Cooperative Fire Services Agreement with the University is new and in addition to the updated Cooperative Policing Agreement approved by City Council on December 21, 2009 (R-09-490).   
 
Services and support under the Agreement are to be provided by the City Fire Department (AAFD) to Athletics and OSEH Fire Safety Services for special events and activities outside the perimeters of State of Michigan Fire Protection Grant services. The City will be reimbursed for the actual cost of personnel and other costs incurred in the provision of services.
 
The Agreement is recommended by staff for approval.

Whereas, Cooperative fire services agreements between agencies ensure that procedures are in place to maintain fire services in the event of an emergency or disaster than necessitate the immediate provision of fire services to prevent the loss of life or property;
 
Whereas, Cooperative fire services agreements also provide jurisdictional and procedural direction needed to coordinate services during both planned and unplanned events;
 
Whereas, The University of Michigan receives currently receives fire services from the City of Ann Arbor under the State of Michigan Fire Protection Grant;   
 
Whereas, The City of Ann Arbor Fire Department (AAFD) and the University of Michigan Department of Public Safety (UMDPS) have determined that a separate agreement is necessary and appropriate to address jurisdictional, financial, command and control and other issues impacting the delivery of fire services in connection with University of Michigan athletic and special events and activities outside the perimeters of State of Michigan Fire Protection Grant; and
 
Whereas, The University of Michigan has approved and executed the Cooperative Fire Services Agreement;
 
RESOLVED, That City Council approve a Cooperative Fire Services Agreement with the University of Michigan to address jurisdictional, financial, command and control and related issues in the delivery of fire services for University of Michigan athletic and special events and activities outside the perimeters of State of Michigan Fire Protection Grant;
 
RESOLVED, That the Mayor and City Clerk be authorized and directed to execute the Cooperative Fire Services Agreement after approval as to substance by the City Administrator and approval as to form by the City Attorney; and
 
RESOLVED, That the City Administrator and the Safety Services Area Administrator be authorized to take the necessary administrative actions to implement this Resolution.
