Memorandum

Attached for your review and consideration, please find a resolution to approve a contract between the City of Ann Arbor and the Michigan Department of Transportation (MDOT) for the construction phase of the Scio Church Road Improvement Project.  The agreement prescribes the cost sharing of the construction, as well as each party’s rights and responsibilities, and is required for the project to receive its share of federal funding from the Surface Transportation Program (STPU).

 

This project consists of resurfacing Scio Church Road between South Maple Road and South Seventh Street, filling sidewalk gaps on the north side of the road, installing three (3) new crosswalks, converting on-street parking into bike lanes, and adding stormwater infiltration.

 

The project will include the addition of 3500 feet of new buffered bike lanes on the north side of Scio Church between S Maple and Greenview that is currently on-street parking and 1400 feet of new buffered bike lanes on the south side of Scio Church between S Maple and Old Pear Tree Court which will increase the bike network by approximately 0.928 miles.  Also, the project will also convert 2100 feet of an existing bike lane on the south side of Scio Church between Old Pear Tree Court to Greenview into a protected buffered bike lane and will include the addition of three new crosswalks which will increase the walkability of the neighborhood. 

 

Construction is expected to begin on or after late September of 2022 and be completed in the spring of 2023.

 

MDOT accepted the City’s final submittal in July 2022, and the project was advertised in August for a September 2022 MDOT bid letting.  This memorandum and resolution were prepared prior to the letting date, so bid prices were not available.  MDOT will award a contract to the qualified low bidder and administer the contract.  The City will act as the project engineer.

 

Budget/Fiscal Impact:  The Engineer’s estimate for the project’s construction is $2,045,555.00. The estimated total cost of the project is $2,892,428.00. In total, the City will be receiving approximately $1,112,428.00 in Federal funds for this project.  The federal funding will be used to fund participating construction expenses.  The City will be funding its share of the construction costs and the design, construction engineering, and material testing costs. Ann Arbor Public Schools will be paying for the local share of the new sidewalk adjacent to their property between Greenview and Seventh Street.

Appropriations are necessary to allocate the major funding sources to the existing Scio Church Road Resurfacing Project; as well as reimburse the general fund for the design costs that were appropriated via R-19-511 for $20,000.00 in project costs for the design and construction of the new sidewalk was originally planned to be special assessed, requiring the upfront design costs be appropriated from the general fund.  With the approval of the Sidewalk Construction Millage, special assessment is no longer required; therefore, the general fund will be reimbursed for the upfront costs.

 

The additional buffered bike lanes, streetlights and RRFB’s will increase yearly maintenance costs by an estimated $16,970.00:

Whereas, the Scio Church Resurfacing Project will improve the pavement conditions between South Maple Road and South Seventh Street and incorporate new bicycle lanes, sidewalks, and crosswalks into the final design;

 

Whereas, The City of Ann Arbor will receive Federal funding from the Surface Transportation Program - Urban (STPU);

 

Whereas, The City share of the funding for this project is available in the approved Street, Bridge, and Sidewalk Millage, Water Supply System, Stormwater Sewer System, and the Sidewalk Construction Millage Capital Budgets;

 

Whereas, Funding for the design and public engagement efforts for the sidewalk portion of the project was previously appropriated from the General Fund;

 

Whereas, Ann Arbor Public Schools will be paying for their local share of the new sidewalk adjacent to their property between Greenview and Seventh Street;

and

 

Whereas, It is necessary to approve the cost sharing agreement with the Michigan Department of Transportation so that the project can proceed.

 

RESOLVED, That the Scio Church Road Resurfacing Project expenditure and revenue budgets be increased by $407,000.00 with the sources of funding being the appropriation of the approved Water Supply System Capital Budget ($115,000.00), the approved Stormwater Capital Budget ($240,000.00), the approved Sidewalk Construction Fund Capital Budget ($70,000.00), and the Ann Arbor Public Schools’ share ($45,000.00);

 

RESOLVED, That $20,000.00 originally appropriated via Resolution R-19-511for the new sidewalk portion of the project design and public engagement be reimbursed to the General Fund; 

 

RESOLVED, That the Mayor and City Clerk be authorized and directed to execute Michigan Department of Transportation Contract No. 22-5349 for the Scio Church Road Resurfacing Project, substantially in the form on file with the City Clerk, following approval as to substance by the City Administrator, and approval as to form by the City Attorney; and

 

RESOLVED, That the City Administrator be authorized to take the necessary administrative actions to implement this resolution including approval of needed Traffic Control Orders, night work authorizations, and other similar administrative approvals to allow the work of the project to proceed without delay.
