Memorandum

Attached for your review and action is a resolution to approve a professional services contract in the amount of $192,032.00 with Beckett and Raeder, Incorporated, to oversee the implementation of the construction project (R-09-468, Resolution to Award a Conditional Contract to Site Development, Inc. in the Amount of $1,374,082.00) at West Park.

 

Beckett and Raeder Inc. was initially under contract to design a storm water master plan for West Park, to oversee geotechnical investigation and surveying, and to produce construction documents.  This work was completed under an existing general professional services contract which enabled pre-qualified consultants to perform work related to park projects (R-08-239).

 

As Beckett and Raeder, Inc. has performed the work on the West Park project thus far, they are the most qualified to continue work on this project.  The construction oversight includes daily field inspection for approximately 30 weeks, as well as providing the documentation necessary to fulfill the funding requirements, overseeing the field testing and providing construction reports, providing the permit documents required by the City, and answering questions of the contractor and other testing agencies.

 

Beckett and Raeder, Inc. was the most qualified consultant chosen to perform the work on the West Park project.  It is standard practice for the same consultant to perform design work and construction oversight as they have the most knowledge about the project and a stake in the successful outcome of the construction, both from a liability standpoint, and for the reputation of the firm.

 

The project features the implementation of a stormwater master plan as well as pathway enhancements, stair replacement, seating built into the hillside at the historic bandshell, a boardwalk and wetland overlook, reconfigured parking, basketball court and native prairie and wetland plantings.  The plan incorporates best management practices including bioswale wetlands and hydrodynamic separators that will reduce sediment and phosphorus inputs to Allen Creek from non-point sources.

 

These storm water Best Management Process (BMP) improvements have been approved for funding through a low interest (2.5%) State Revolving Fund (SRF) loan to the Washtenaw County Water Resources Commissioner (Resolution 09-390).  The County has also applied for American Recovery and Reinvestment Act (ARRA) funding, which would reduce the loan amount by 40%.

 

This work is being funded in part by the Park Maintenance and Capital Projects Millage ($30,000.00) and the remainder by the storm water maintenance fund ($162,032.00); the latter of which will be repaid as a loan to the State Revolving Fund (SRF).  This breakdown reflects the percentage of work that covers park improvements versus the amount that addresses storm water quality.  Construction is scheduled to begin in Spring of 2010.

 

Beckett and Raeder, Inc, received Human Rights approval on May 7, 2009.  The consultant complies with the living and prevailing wage ordinance.

Whereas, Proposed improvements include a series of bioswales, wetland and detention basins as well as boardwalks and stairs, paths, bandshell seating, parking lot reconfiguration, relocation of the basketball court, wetland and prairie plantings, and other landscaping;

 

Whereas, Beckett and Raeder Inc. has produced the construction documents and the construction project was approved by City Council on November 16, 2009, and the implementation will take place in the Spring and Summer of 2010;

 

Whereas, Beckett and Raeder, Inc. would oversee the implementation of the construction project, including full time on site field inspections during the construction phase;

 

Whereas, Funds for the contract are included in the FY 2010 approved Park Maintenance and Capital Improvements Millage budget in the amount of $30,000.00 and the State Revolving Fund (SRF) and the American Recovery and Reinvestment Act  (ARRA) funding will cover $162,032.00;

 

Whereas, Beckett and Raeder, Incorporated received Human Rights approval on May 7, 2009 and complies with the living wage and prevailing wage requirements;

 

RESOLVED, That City Council approve the professional services contract with Beckett and Raeder, Incorporated in the amount of $192,032.00 for the life of the project without regard to fiscal year;

 

RESOLVED, That the Mayor and City Clerk be authorized and directed to execute the contract after approval as to substance by the City Administrator and approval as to form by the City Attorney.
