Memorandum
There is a resolution before you to accept an easement for the construction and maintenance of public utilities from the Mercedes-Benz Research & Development North America, Inc., a Delaware corporation.
 
The easement is in standard form and conveyed without cost to the City.
 
Acceptance of the easement is recommended.

Whereas, Mercedes-Benz Research & Development North America, Inc., a Delaware corporation, is the fee simple owner of property located in the City of Ann Arbor, Washtenaw County, Michigan as described in the Washtenaw County Records at Liber 1669, Page 602, recorded August 31, 1978;
 
Whereas, Action By Written Consent of the Board of Directors in Lieu of Meeting, dated October 27, 2009, authorized the delivery of a perpetual easement to the City for public utilities; and
 
Whereas, Mercedes-Benz Research & Development North America, Inc., has delivered an easement to the City for the construction and maintenance of municipally operated public services comprising the public utilities system to run with the land and burden the respective property perpetually, being more particularly described as follows:
 
Description of a 40 Foot Wide Easement for Watermain over Tax Parcel 09-12-09-302-005:
 
Part of Lot 13 of “Research Park,” a Subdivision of Part of the SW 1/4 of Section 9, T3S  R6E, City of Ann Arbor, Washtenaw County, Michigan, as recorded in Liber 15 of Plats, Page 56, Washtenaw County Records more particularly described as follows:  Beginning at the Northwest Corner of Lot 13; thence along the North line of Lot 13, N 87°53'20" E, 135.19 feet; thence S 02°06'40" E, 48.26 feet; thence S 87°53'20" W, 44.00 feet; thence N 02°06'40" W, 8.26 feet; thence S 87°53'20" W, 96.53 feet; thence along the Easterly Right-of-Way of Research Park Drive (80 foot wide Right-of-Way), on the arc of a curve to the left, having a length of 40.36 feet, a radius of 3477.72 feet, a central angle of 00°39'53", and a long chord which bears N 05°29'32" E, 40.35 feet, to the POINT OF BEGINNING.
 
Description of a 25 Foot Wide Easement for Public Utilities over Tax Parcel 09-12-09-302-005:
 
Part of Lot 13 of “Research Park,” a Subdivision of Part of the SW 1/4 of Section 9, T3S  R6E, City of Ann Arbor, Washtenaw County, Michigan, as recorded in Liber 15 of Plats, Page 56, Washtenaw County Records more particularly described as follows:  Beginning at the Southwest Corner of Lot 13; thence along the Easterly Right-of-Way of Research Park
 
Drive (80 foot wide Right-of-Way), on the arc of a curve to the left, having a length of 25.56 feet, a radius of 3477.72 feet, a central angle of 00°25'16”, and a long chord which bears N 09°53'32” E, 25.56 feet; thence N 87°53'20” E, 495.72 feet; thence along the East line of Lot 13, S 08°20'20” E, 25.15 feet; thence along the South line of Lot 13, S 87°53'20” W, 503.76 feet to the POINT OF BEGINNING.
 
RESOLVED, That the City hereby accepts said grant of easement.
