An Ordinance to Amend Section 10:77 (Parking Fines) of Chapter 126, Traffic, of Title X of the Code of the City of Ann Arbor (Ordinance No. ORD-10-03)
Memorandum
The City periodically reviews its schedule of parking fines and makes adjustments based on those findings. During this review, City staff determined that Article VII, 10:77 could be simplified by:
1. Removing specific fines for violations 10:67 (Handicap), 10:68 (Odd/Even Parking Districts) and 10:143(1) (Snow Emergencies) and allowing adoption by Resolution as with all other parking fines,
2. Removing a redundant reference to the Michigan Vehicle Code, and
3. Simplifying language.
City staff recommends approval of this Ordinance amendment.

PARKING FINES
An Ordinance to Amend Section 10:77 of Chapter 126 of Title X of the Code of the City of Ann Arbor.
The City of Ann Arbor Ordains:
Section 1. That Section 10:77 of Chapter 126 of Title X of the Code of the City of Ann Arbor be amended to read as follows:
10:77. Penalties for parking violations.
(1) Violation of Section 10:67 shall be punishable by a civil fine of $75.00 or otherwise established by section 907(2) of the Michigan Vehicle Code.
(2)(1) Violations of sections 10:50 through 10:66(73) inclusive, 10:69 through 10:71 inclusive, section 10:72(2), Section 10:73 and section 10:136(4) and 10:143(1), shall be punishable by a civil fine as provided by Resolution of City Council adopted in accordance with 10:77(35) AND SHALL CONFORM WITH SECTION 907(2) OF THE MICHIGAN VEHICLE CODE, WHERE APPLICABLE.
(2) (3)Violations of section 10:50 through 10:73 inclusive, and section 10:136(4), and 10:143(1)10:72(1) shall be punishable by a civil fine, except that reduced penalties for violations of section 10:72 may be allowed as provided by Resolution of the City Council adopted in accordance with 10:77(35).
(4) Violations of sections 10:68 and 10:143(1) shall be punishable by a civil fine of $125 or as otherwise provided by Resolution of the City Council.
(5)(3) A schedule of civil fines shall be adopted by City Council annually. Unless specifically stated otherwise in this Chapter, all civil fine shall be governed by this schedule. The schedule will identify the specific violation, its fine, and any reduction based on early payment or increase based on delinquency.
Section 2: In the event any court of competent jurisdiction shall hold any provision of this Ordinance invalid or unenforceable, such holding shall not invalidate or render unenforceable any other provision thereof.
Section 3: This Ordinance shall take effect ten days after passage and publication.
