Memorandum
There is a resolution before you to accept an easement for public road right-of-way from ALDI INC. (MICHIGAN), a Michigan corporation.  The easement is for the northerly thirty-three feet from the centerline of Dexter Avenue.
The easement is in standard form and conveyed without cost to the City.
Acceptance of the easement is recommended.

Whereas, ALDI INC. (MICHIGAN), a Michigan corporation, is the owner in fee simple of property located in the City of Ann Arbor, Washtenaw County, Michigan as described in the Washtenaw County Records at Liber 4708, Page 768, recorded December 3, 2008;
 
Whereas, Action By Written Consent of the Directors of ALDI INC. (MICHIGAN), dated June 23, 2003, authorizes the delivery of an easement to the City for public road right-of-way along the northerly side of Dexter Avenue; and
 
Whereas, ALDI INC. (MICHIGAN) has delivered an easement to the City for the public road right-of-way to run with the land and burden the respective property perpetually, being more particularly described as follows:
 
Area to be dedicated as public right-of-way:
 
A part of the NW 1/4 of  Section 30, T2S, R6E, City of Ann Arbor, Washtenaw County, Michigan Described as:  Commencing at the SE Corner of Section 24, T2S, R5E, City of Ann Arbor, Washtenaw  County, Michigan; thence N00°06'06"W 184.38 feet along the E line of said  Section 24, the W line of said Section 30 and the centerline of Maple Road to a Point on the Westerly extension of the S line of "MAPLE RIDGE", a subdivision in the SW 1/4 of Section 19, T2S, R6E, City of Ann Arbor, Washtenaw County, Michigan as recorded in Liber 12 of Plats, Pages 47 & 48, Washtenaw County Records; thence S89°36'20"E 2.25 feet (recorded as S89°24'30"E) along the said Westerly extension to the NW  Corner of Section 30, T2S, R6E, City of Ann Arbor, Washtenaw County, Michigan (as monumented); thence continuing  S89°36'20" E 40.00 feet  to a point on the E line of said Maple Road; thence along said E line S00°35'54"W 131.49 feet to the intersection of said E line with the N line of Dexter Avenue; thence along said N line S68°33'52"E 291.58 feet to the Point of Beginning; thence continuing along said N line S68°33'52"E 150.00 feet; thence S24°10'12"W 33.04 feet to the centerline of said Dexter Avenue; thence along said centerline N68°33'52"W 150.00 feet; thence N24°10'12"E 33.04 feet to the Point of Beginning, containing  4950 square feet of land, more or less.
 
RESOLVED, That the City of Ann Arbor hereby accept said grant of easement.
