Resolution to Approve Change Order and Increase Contract Amount with Delta Temp, Inc. for Buhr Park Ice Arena Floor Slab System Replacement ( $70,048.98 Change Order/$696,136.18 Total Contract)

Attached for your review and approval is a resolution to approve a change order and increase in the contract amount with Delta Temp, Inc. by $70,048.98 for the replacement of the Buhr Park Ice Arena floor slab system, for a total contract amount of $696,136.18. On September 8, 2009, Council approved resolution R-09-371 for a contract with Delta Temp, Inc. in the amount of $626,087.20 for the replacement of the Buhr Park Ice Arena floor slab system.
A three week delay in the project occurred when an inspection raised questions regarding the type of piping being installed. The contractor and manufacturer of the piping were required to provide additional technical information. While this issue has been satisfactorily resolved, the delay has resulted in construction taking place in colder weather conditions and a modified specification concrete is now required. The $70,048.98 increase in the contract is to cover the increased costs for the concrete additive as well as costs to temporarily enclose and heat the arena during the concrete pouring and setting up period.
With your approval of this change order and increase to the contract for $70,048.98 the contract with Delta Temp, Inc will be for a revised total amount of $696,136.18 ($626,087.20 for the original contract, plus $70,048.98 in additional funding to meet modified specifications to complete the work). Funding for the increase to the contract is included in the FY 10 approved Park Rehabilitation and Development Millage budget.
An anticipated opening date of January 9, 2010 is now scheduled for Buhr Park Ice Arena. Staff is working with Buhr Park users to find alternative ice times at Veteran's Ice Arena during the delay.
Delta Temp, Inc. received Human Rights Approval on August 14, 2009. The contractor complies with the living and prevailing wage ordinance.

Whereas, It is necessary to approve a change order and increase the contract amount with Delta Temp Inc. for the needed replacement of the Buhr Park Ice Arena floor slab system;
Whereas, Funds are available in the FY 10 approved Park Rehabilitation and Development Millage budget; and
Whereas, Delta Temp, Inc. received Human Rights approval on August 14, 2009 and complies and the living wage and prevailing wage requirements;
RESOLVED, That Council approve the change order and increase the existing contract amount with Delta Temp Inc. in the amount of $70,048.98 (to a total value of $696,136.18) for the replacement of the Buhr Park Ice Arena Floor Slab System;
RESOLVED, That the Mayor and City Clerk be authorized and directed to execute the contract after approval as to substance by the City Administrator and approval as to form by the City Attorney; and
RESOLVED, That the City Administrator be authorized to take all necessary administrative actions to implement this resolution including the authority to approve change orders within the approved contingency.
