Resolution to Approve the Fuller Road Station: Master Concept Plan, Amend the Agreement with JJR, LLC, and Amend the Existing Project Budget ($111,228.00)

Attached for your consideration is a resolution to approve the Fuller Road Station: Master Concept Plan, authorize continued effort on the Fuller Road Station: Phase One Concept Plan, amend the existing project budget, and amend the existing agreement with JJR, LLC. Council approved Resolution #R-09-343 authorizing Professional Services with JJR, LLC in the amount of $541,717.00 for conceptual design, environmental assessment and engineering services related to the Fuller Road Station project. Deliverable Number One of this effort was to confirm the Phase One Concept Plan and identify the Phase One development footprint. That effort has been completed and was presented to the Council at the October 12, 2009 Working Session and is now on the Council agenda for approval.
The City owns the land containing the existing southern surface parking lot along Fuller Road and has determined that this area is: uniquely suited as adjacent to the existing Amtrak passenger rail service corridor, which is proposed to accommodate commuter rail service linking Ann Arbor to Metro airport and Detroit and has been designated as a national high-speed corridor between Detroit and Chicago; immediately adjacent to the University Medical center campus with thousands of employees and visitors daily; able to provide direct pedestrian access to jobs and medical services; accessible to bus transport via Fuller and East Medical Center Drive and is along a proposed signature transit corridor identified in the City's recent Transportation Plan Update; and adjacent to the Washtenaw County Border to Border Trail.
A set of conceptual plans emerged from a two-day workshop which was convened by JJR, LLC., on August 26 and 27, 2009. The working session included representatives from the City, the University of Michigan (UM), Ann Arbor Transportation Authority, and other transportation related agencies, resulting in the development of a set of Fuller Road Station: Workshop Concept Plan and Phase l Plans. The Workshop Concept Plans were subject to public review in response to Council's direction to create an opportunity for public input into the development of the preliminary conceptual plans. This was accomplished through meetings with the City Planning Commission on September 10, 2009, the Parks Advisory Commission on September 15, 2009, and a public open house convened on September 17, 2009. The Fuller Road Station: Master Concept Plan (Exhibit B) and Phase One Concept Plan (Exhibit A) reflect comments received on the Fuller Road Station: Workshop Concept Plan drawings.
The Fuller Road Station: Master Concept Plan (Master Concept Plan) emerged as a result of the workshop and subsequent public input. The Master Concept Plan includes an intermodal facility containing parking, an eight bus platform area, an area for a 'full-service' bicycle station, skywalk connections to the UM Hospital, and a train station, a drop-off area, a covered connection linking the train station with the intermodal facility, an expanded system of bike paths and connections, a linkage with the proposed signature transit corridor identified in the City's Transportation Plan update, as well as other elements.
At this time, the City and UM desire to pursue development of the Fuller Road Station: Phase One Concept Plan project (Phase One Project) for an intermodal transportation facility, which includes a bus loading platform with provisions for up to four bus stops, an enclosed transit waiting area, a bicycle storage area and a parking structure with approximately 900 parking spaces on levels two and above as well as a surface parking lot with approximately 50 parking spaces.
The attached resolution requests the approval of the Master Concept Plan and seeks authorization for the continuing development of the Phase One Project. There is a companion Memorandum of Understanding (MOU) resolution that will provide a basis for City and University of Michigan's cost participation in the Phase One Project, as well as the mutual understanding of the parties for use of the facilities as agreements for operation and use of the facility that are developed. In advance of those agreements, the MOU allows the design work to begin by the respective parties with the knowledge that there is agreement in principle to guide the development of the future contracts. Minimizing delays in these early phases of the design process are critical to meeting the required project completion date of June, 2012.
the attached resolution also seeks approval of an amendment to the project budget in the amount of $111,228.00 to cover funding for Amendment One to the Professional Services Agreement with JJR, LLC., for Phase I engineering services for the Fuller Intermodal Transportation Station, now known as Fuller Road Station and seeks approval of Amendment One to the Professional Services Agreement with JJR, LLC., for those engineering services, also in the amount of $111,228.00. This Amendment One will allow continuation of the effort to complete engineering designs plans and specifications for utility and roadway elements of the Fuller Road Station: Phase One program.
Funds are available for the amendments as follows:

Whereas, The City and University of Michigan (UM) have collaborated on development of transportation plans including the City's 2009 Transportation Plan update and find continuing to implement planning recommendations as necessary and desirable;
Whereas, The City and UM agreed to partner in the development of conceptual plans for an intermodal facility located on city-owned land along Fuller Road;
Whereas, The City has entered into an Agreement with JJR, LLC., to prepare plans and designs for the Fuller Intermodal Transportation Station which can be amended to continue development of engineering design, plans and specifications for the Fuller Road Station: Phase One Concept Plan project;
Whereas, A two-day workshop was convened on August 26 and 27, 2009, which included representatives from the City, the UM, Ann Arbor Transportation Authority, and other transportation related agencies, resulting in the development of a Fuller Road Station: Workshop Concept Plan containing the elements presented to the City Council at its meeting of August 17, 2009, and as defined below;
Whereas, The City Council directed staff to create an opportunity for public input into the development of the preliminary conceptual plan which was accomplished through meetings with the City Planning Commission on September 10, 2009, the Parks Advisory Commission on September 15, 2009, and a public open house convened on September 17, 2009, receiving comments reflected in the Fuller Road Station: Master Concept Plan and Phase One Concept Plan drawings and documents;
Whereas, The Fuller Road Station: Master Concept Plan includes an intermodal facility containing parking, an eight bus platform area, an area for a bicycle station, skywalk connections to the UM Hospital, and a train station, a drop-off area, a covered connection linking the train station with the intermodal facility, additional multi-use trail connections, a linkage with the proposed signature transit corridor identified in the City's Transportation Plan update, as well as other elements;
Whereas, The City and UM desire to pursue development of the Fuller Road Station: Phase One Concept Plan including an intermodal transportation facility, which includes a bus loading platform with provisions for up to four bus stops, an enclosed transit waiting area, a bicycle storage area and a parking structure with approximately 900 parking spaces on levels two and above as well as a surface parking lot with approximately 50 parking spaces; and
Whereas, The project can be phased such that the Fuller Road Station: Phase One Concept Plan project can advance while future phases evolve on their respective timelines;
Resolved, In consideration of the above, the City of Ann Arbor approves the Fuller Road Station: Master Concept Plan and authorizes the development of the Fuller Road Station: Phase One Concept Plan project, under the terms outlined for the development of the project in the Fuller Road Station Memorandum of Understanding (MOU);
Resolved, That the Professional Services Agreement with JJR, LLC for Phase I engineering services for the Fuller Intermodal Transportation Station, now known as Fuller Road Station, be amended in the amount of $111,228.00 to complete engineering designs plans and specifications for utility and roadway elements of the Fuller Road Station: Phase One Concept Plan program;
RESOLVED, That the existing project budget be amended by $111,228.00 as indicated below and be available without regard to fiscal year;

RESOLVED, That any funds recaptured as a result of the provisions for sharing of costs in accordance with the MOU for the Fuller Road Station be returned to the above referenced Funds on a proportional basis;
RESOLVED, That the Mayor and City Clerk be authorized and directed to execute the amendment to the Professional Services Agreement with JJR, LLC after approval as to form by the City Attorney, and approval as to substance by the City Administrator; and
RESOLVED, That the City Administrator be authorized to take the necessary administrative actions to implement this resolution.
