Memorandum
Attached for your review and approval is a resolution to award a contract to DownUnder Municipal Services, LLC in the amount of $160,806.00 for the 2009 Sewer Cleaning and Televising Project.  
 
The purpose of the Sewer Cleaning and Televising Project is to clean various storm and sanitary sewer pipes throughout the City, and inspect the condition of the pipes.  This work is scheduled to be done in advance of the design work for various other road and utility projects in order to determine the need for repair and/or replacement of the sewer lines in conjunction with those projects.
 
The project is created as a unit price contract with the understanding that the actual quantities used in construction will vary.  If the funds are depleted prior to the completion of all the streets listed on the attachments, the construction contract will be terminated and the remainder of the work will be performed by the City's Field Operations Services Unit.
 
Contract specifications were distributed electronically to contractors, subcontractors, and suppliers. Four bids were received and opened on September 15, 2009.  The lowest responsible bid, in the amount of $266,960.00 is $5,305.00 lower than the engineer's estimate of $272,265.00.  A tabulation of the bids is also attached.
 
After reviewing the bids, it was determined that, due to budgetary constraints, the contract amount would be reduced by approximately 45%, to a new total of $160,809.00.  This change in the contract amount is agreeable to the Contractor.
 
DownUnder Municipal Services, LLC received Human Rights approval on September 16, 2009.  All employees of DownUnder Municipal Services, LLC, assigned to work on the project will receive compensation in accordance with the Living Wage Ordinance.
 
The project will be funded from the FY 2010 Public Service, Field Operations Sewage Disposal and Storm Water Funds Operation and Maintenance Budgets.

Whereas, The 2009 Sewer Cleaning and Televising Project includes the cleaning and television of various storm and sanitary sewer pipes throughout the City;
 
Whereas, The 2009 Sewer Cleaning and Televising Project is necessary to provide needed information on the condition of the sewer lines in advance of the design and construction of related projects;
 
Whereas, Competitive bids were received by Procurement on September 15, 2009 and DownUnder Municipal Services, LLC was the lowest responsible bidder at $266,960.00;
 
Whereas, Following review of the bids, the City elected to reduce the scope of services and thereby reduce the contract amount to a total of $160,809.00, a change that is agreeable to the Contractor;
 
Whereas, The contractual proposal sets forth the services to be performed by said company, and the payments to be made by the City therefore, all of which are agreeable to the City;
 
Whereas, Funding for the project is available in the Approved FY 2010 Field Operations Sewage Disposal Fund ($80,405.00) and Storm Water Fund ($80,404.00);
 
Whereas, It is now necessary to enter into a Contract with said company for said construction project; and
 
Whereas, DownUnder Municipal Services, LLC received Human Rights approval on September 16, 2009, and its employees will receive compensation in accordance with the Living Wage Ordinance;
 
RESOLVED, That a contract in the amount of $160,809.00 be awarded to DownUnder Municipal Services, LLC for the construction of the 2009 Sewer Cleaning and Televising Project;
 
RESOLVED, That the Mayor and City Clerk be authorized and directed to execute said contract after approval as to form by the City Attorney and approval as to substance by the City Administrator; and
 
RESOLVED, That the City Administrator be authorized to take the necessary administrative actions to implement this resolution.
