Memorandum
Attached for your review and approval is a resolution to authorize a Professional Services Agreement with Fishbeck, Thompson, Carr & Huber, Inc. (FTC&H) for Professional Engineering Services in the amount of $54,271.69 for the Sylvan Avenue Permeable Pavement.  
 
Sylvan Avenue consists of an approximately 800-foot long residential street, which extends between Packard Street and White Street. Sylvan Avenue was originally scheduled to be resurfaced in 2009 as part of the Local Street Resurfacing Project.  After observing problems on the street caused by poor drainage, the project was postponed until 2010 in order to develop a solution to these problems.  
 
Further investigation determined that Sylvan Avenue could be a good candidate for design of a permeable pavement system, which could potentially allow storm water to infiltrate through the pavement rather than going directly into the storm sewer system.  This in turn would help improve the quality and quantity of storm water in the Allen Creek watershed, in which this project is located.
 
The Project Management Services Unit issued a Request for Proposal (RFP #738) in July of 2009 for a professional engineering firm to analyze and design a permeable pavement system for Sylvan Avenue.  In response to our request, we received nineteen (19) proposals.  A review team composed of City staff evaluated the proposals, interviewed three firms,  and selected Fishbeck, Thompson, Carr & Huber, Inc. for their proposed work plan, staff qualifications, past involvement with similar projects, and competitive fee schedule. FTC&H has received Human Rights and Living Wage approval on August 19, 2009.  
 
Services to be performed include all the required surveying, analysis, design, and permitting for the project, as well as the development of complete project plans and specifications.  
 
Sylvan Avenue is located in the Allen Creek drainage district, which is an established Chapter 20 County Drain.  Therefore, the work to design and construct storm water improvements in the drainage district falls under the jurisdiction of the Washtenaw County Water Resources Commissioner (WCWRC).  The WCWRC has been approved for a low interest (2.5%) State Revolving Fund (SRF) loan for the design and construction of this project.  This resolution is to authorize the design of the project.
 
Sufficient funds for the design engineering services of this permeable pavement project are available in the approved FY10 Stormwater Capital Budget.

Whereas, The project is necessary to improve the condition of Sylvan Avenue and solve drainage problems;
 
Whereas, Proposals were received by Procurement and evaluated by City staff on the basis of qualifications, past involvement with similar projects, proposed work plan, and cost;
 
Whereas, Fishbeck, Thompson, Carr & Huber, Inc. of Farmington Hills, Michigan has submitted to the City a proposal for the necessary services, setting forth the services to be performed by said firm and the payments to be made by the City therefore, all of which are agreeable to the City;
 
Whereas, Fishbeck, Thompson, Carr & Huber, Inc. received Human Rights and Living Wage approval on August 19, 2009; and
 
Whereas, The required funds for the Professional Engineering Services are available in the in the approved FY10 Stormwater Capital Budget project budget;
 
RESOLVED, That a Professional Services Agreement with Fishbeck, Thompson, Carr & Huber, Inc. in the amount of $54,271.69 be approved for Professional Engineering Services for the Sylvan Avenue Permeable Pavement Project;
 
RESOLVED, That the Mayor and City Clerk be authorized and directed to execute said agreement after approval as to form by the City Attorney and approval as to substance by the City Administrator;
 
RESOLVED, That City Council authorize the City Administrator to approve change orders to the agreement within the project budget;
 
RESOLVED, That the City Administrator be authorized to take the necessary administrative actions to implement this resolution; and
 
RESOLVED, That a contingency amount of $5,400.00 be established within the project budget and that the City Administrator be authorized to approve additional Amendments to the Professional Services Agreement with Fishbeck, Thompson, Carr & Huber, Inc., not to exceed $5,400.00 in order to satisfactorily complete this project.
