Resolution to Accept a Sanitary Sewer Easement at 2101 and 2141 Medford Road from Ann Arbor Woods Apartments, LLC (8 Votes Required)

Memorandum

This easement is for both an existing sanitary sewer for which the City did not have an executed recorded easement and a newly construction portion of sanitary sewer.

 

This easement is in standard form and is conveyed without cost to the City.

 

Acceptance of this easement is recommended.

Whereas, Ann Arbor Woods Apartments, LLC is the owner of property commonly known as 2101 and 2141 Medford Road, by virtue of deed recorded in Liber 5263, Page 719 of Deeds, Washtenaw County Records; and

 

Whereas, Ann Arbor Woods Apartments, LLC has signed a grant of easement for sanitary sewers and appurtenances as shown and described on the attached map:

 

PERMANENT SANITARY SEWER EASEMENT DESCRIPTION COMMENCING AT THE SOUTH 1/4 CORNER OF SECTION 34, T.2S. R.6E., CITY OF ANN ARBOR, THENCE S87°34'34"W 284.29 FEET ALONG THE SOUTH LINE OF SAID SECTION 34 TO THE POINT OF BEGINNING; THENCE S02°25'36"E 19.80 FEET; THENCE S72°13'41"W 67.32 FEET TO AN EXISTING 15' PLATTED SEWER EASEMENT; THENCE N04°21'06"E 37.88 FEET ALONG SAID EASEMENT LINE TO THE SOUTH LINE OF SAID SECTION 34, ALSO BEING THE NORTH LINE OF LOT 2, ARBOR WOODS SUBDIVISION AS RECORDED IN LIBER 17 OF PLATS PAGES 35-36; THENCE N87°34'34"E 60.45 FEET ALONG SAID LINE TO THE POINT OF BEGINNING. THIS EASEMENT IS SITUATED IN SAID LOT 2 ARBOR WOODS SUBDIVISION WHICH IS IN THE NW 1/4 OF SECTION 3, T.3S., R.6E. CITY OF ANN ARBOR, WASHTENAW COUNTY, MICHIGAN.

PERMANENT SANITARY SEWER EASEMENT DESCRIPTION COMMENCING AT THE SOUTH 1/4 CORNER OF SECTION 34, T.2S. R.6E., CITY OF ANN ARBOR, THENCE S87°34'34"W 359.84 FEET ALONG THE SOUTH LINE OF SAID SECTION 34 TO THE POINT OF BEGINNING; THENCE S04°20'57"W 27.75 FEET ALONG AN EXISTING 15' PLATTED SEWER EASEMENT; THENCE S87°44'40"W 261.50 FEET; THENCE N02°25'26"W 26.77 FEET TO THE SOUTH LINE OF SAID SECTION 34, ALSO BEING THE NORTHLINE OF LOT 1 AND LOT 2, ARBOR WOODS SUBDIVISION AS RECORDED IN LIBER 17 OF PLATS PAGES 35-36; THENCE N87°34'34"E 264.78 FEET ALONG SAID LINE TO THE POINT OF BEGINNING. THIS EASEMENT IS SITUATED IN SAID LOT 1 AND LOT 2 ARBOR WOODS SUBDIVISION WHICH IS IN THE NW 1/4 OF SECTION 3, T.3S., R.6E. CITY OF ANN ARBOR, WASHTENAW COUNTY, MICHIGAN.

 

RESOLVED, That the City of Ann Arbor hereby accepts this grant of easement.
