Memorandum

Attached for your approval is a resolution to appropriate $10,000.000 from the General Fund fund balance to amend the FY21 General Fund Budget for technical support related to the Gelman Litigation, which will be managed through an existing professional services agreement with Tetra Tech.

 

Tetra Tech has been providing the city with professional hydrogeological services related to the Gelman Plume for several years.  The majority of the work that they have performed has been related to the placement of sentinel wells strategically located to protect the city’s water supply from migrating 1,4 dioxane. 

 

This resolution is to appropriate funds for professional hydrogeological services at the request of the City Attorney in support of the ongoing litigation with Gelman Sciences.  This work includes the theoretical review of a National Pollution Discharge Elimination System (NPDES) permit for a proposed discharge into the First Sister Lake.  Any follow up work related to this review or to the litigation would is also intended to be included as part of this appropriation request and change order.

 

Budget/Fiscal Impact: Since the FY21 General Fund Budget was formulated prior to the identification of the additional NPDES oversight requirements, an appropriation and budget amendment are necessary.  Fund Balance is available in the General Fund for this appropriation.

Whereas, The FY21 General Fund Budget was formulated prior to the identification of hydrogeological technical services by the City Attorney’s office;

 

Whereas, Tetra Tech has provided professional hydrogeological services to the city in support of the Gelman plume for several years;

 

Whereas, The Tetra Tech Engineering Services Professional Services Agreement has capacity in their contract for this additional work;

 

Whereas, An additional $10,000.00 is requested at this time to increase the remaining budget for this fiscal year to support additional work identified by the City Attorney related to the ongoing litigation with Gelman Science; and

 

Whereas, Funding is available in the General Fund Fund Balance for this effort;

 

RESOLVED, That $10,000.00 be appropriated from the General Fund, fund balance to amend the existing Water Treatment Services FY21 General Fund Budget; and

 

RESOLVED, That the City Administrator be authorized to take the necessary actions to implement this resolution.
