Resolution to Amend the City Attorney Contract

Body

Whereas, The Employment Contract of the City Attorney provides for an annual review of the City Attorney;

 

Whereas, Historically, the Personnel evaluation of the City Attorney by the City Council was done after the conclusion of the fiscal year;

 

Whereas, When Howard Lazarus was hired, his review period was set after the end of the calendar year;

 

Whereas, Because the reviews of the City Attorney and City Administration have usually been done in tandem, on September 12, 2016, the City Council by Resolution R-16-364 amended the City Attorney’s employment contract “to set his future performance evaluations no later than February of the year based on the activities of the prior calendar year, with this schedule to begin in February 2018”;

 

Whereas, The City Council in the employment contract of Tom Crawford as City Administrator has set his personnel review to be after the end of the fiscal year;

 

Whereas, The Council Administration Committee recommended at the January 12, 2021 meeting that the Resolution to move City Attorney’s personnel review to after the end of the fiscal year be brought to the City Council in February; and

 

Whereas, The City Attorney is in agreement with this amendment;

 

RESOLVED, That the City Attorney’s employment agreement be amended to provide that his personnel review be moved to after the end of the fiscal year, and for the review in 2021 cover the 18 months prior to the review and that is January 1, 2020 to June 30, 2021; and

 

RESOLVED, That the Mayor and Clerk are authorized to sign this written amendment.
