Resolution to Approve Memorandum of Understanding (MOU) between the City of Ann Arbor and the University of Michigan for the Hubbard Road/Huron Parkway Stormwater Outlet Repair Project ($210,000.00)

Memorandum

Attached for your approval is a Memorandum of Understanding (MOU) agreement between the City of Ann Arbor and the University of Michigan. Both parties continue to be involved and impacted by the need for repair and maintenance of the open channel of Millers Creek, at Huron Parkway and Hubbard.

 

The City of Ann Arbor and the University of Michigan (UM) desire to formalize an arrangement for the repair of the stormwater outlet and associated downstream impacted areas in the natural creek, and to define maintenance and cost sharing arrangements. 

 

The $420,000.00 costs associated with the repair of the stormwater culvert and associated downstream impacted areas in the natural creek shall be shared in accordance with the following percentages; 

 

University of Michigan                      50%

City of Ann Arbor                      50%

 

The University of Michigan shall invoice the City of Ann Arbor for their share of the costs of construction of the repairs. Staff from the City of Ann Arbor and the University of Michigan will continue to meet to assess all maintenance and capital needs of the facility.

 

The attached memorandum of understanding establishes the responsibilities between the City and the University of Michigan and outlines the obligations of ownership, and maintenance.

Whereas, the City and the University desire to improve stormwater infrastructure erosion protection and sediment management along Huron Parkway at Hubbard, SE corner;

 

Whereas, the City and the University recognize that this is a high priority need and agree that there will be mutual benefit to portions of Millers Creek on both University of Michigan property as well as the community’s watershed at large in completing a joint Stormwater Outlet Repair @ SE Huron Parkway & Hubbard;

 

Whereas, The City and the University of Michigan continue to be involved and impacted by the maintenance and operation of the Hubbard Road/Huron Parkway Stormwater Outlet Repair Project; and

 

Whereas, The City and the University of Michigan wish to formalize an arrangement for the continued operation, maintenance and improvement of Stormwater Outlet @ SE Huron Parkway & Hubbard;

 

RESOLVED, That Council approve the attached Memorandum of Understanding with City of Ann Arbor and the Regents of the University of Michigan for the Hubbard Road/Huron Parkway Stormwater Outlet Repair Project;

 

RESOLVED, That a contingency amount of $21,000.00 be established and the City Administrator be authorized to approve construction change orders not to exceed $21,000.00 in order to satisfactorily complete this project;

 

RESOLVED, That the Mayor and City Clerk be authorized and directed to execute said MOU after approval as to form by the City Attorney, and approval as to substance by the City Administrator; and

 

RESOLVED, That the City Administrator be authorized to take necessary administrative actions to implement this resolution.
