Memorandum
This resolution would approve a grant of easement to the Detroit Edison Company, a Michigan corporation, for the construction and maintenance of underground electrical service across the northerly border of City-owned property at 350 S. Fifth Avenue, the site of the former YMCA, currently being used a public parking lot.
 
The new public parking structure to be constructed under S. Fifth Avenue and the City's S. Fifth Avenue parking structure necessitates the relocation of electric service conduits that currently run north/south along Fifth Avenue and serve the Federal Building and the Library among other buildings.   Detroit Edison Company will redesign this electric service to run east/west from Fourth Avenue to Fifth Avenue, and an easement is needed for the placement of this relocated service and installation of a new ground level transformer on the northerly border of the City's 350 S. Fifth Avenue property.   The proposed 10-foot wide easement route will not negatively impact the existing short-term use of the property or anticipated future redevelopment.  Because the DDA's structure project is triggering the need for this electric system relocation the cost for this work will be included in the parking structure project budget.

Whereas, The Detroit Edison Company, a Michigan corporation, has requested an easement for the construction and maintenance of an underground electric service line, and ground level transformer to be located abutting the northerly border of the City of Ann Arbor's property at 350 S. Fifth Avenue, for the purpose of relocating existing electric service in the 300 block of S. Fifth Avenue necessitated by the construction of the new underground public parking structure; and
 
Whereas, A joint DDA and DTE engineering team recommends construction of this service line as the only feasible option for continuing electrical service for the 300 block of S. Fifth Avenue;
 
RESOLVED, That the City of Ann Arbor approve the grant of easement to The Detroit Edison Company for the construction and maintenance of an underground electric service line, ground level transformer and all other component elements to be located abutting the north border of the City of Ann Arbor's property located at 350 S. Fifth Avenue, said easement being more particularly described as follows:
Beginning at the Southwest corner of Lot 2, Block 3 South, Range 5 East, ORIGINAL PLAT of the Village (now City) of Ann Arbor, Washtenaw County, Michigan; thence N00*23'28"E 6.00 feet along the Easterly right-of-way of South Fourth Avenue; thence S89*22'42"E 132.01 feet along the Northerly line of the Southerly 6 feet of said Lot 2; thence S00*24'33"W 6.00 feet along the Easterly line of said Lot 2; thence S89*22'42"E 132.00 feet along the Northerly line of lot 6, Block 3 South, Range 5 East of said ORIGINAL PLAT; thence S00*25'39"W 10.00 feet along the Westerly right-of-way line of South Fifth Avenue; thence N89*22'42"W 58.00 feet; thence S00*37'18"W 3.00 feet; thence N89*22'42"W 23.00 feet; thence N00*37'18"E 3.00 feet; thence N89*22'42"W 61.00 feet; thence N00*24'33" 6.00 feet; thence N89*22'42"W 122.01 feet; thence N00*23'28"E 4.00 feet along the Easterly right-of-way line of South Fourth Avenue to the Point of Beginning.
