Resolution to Approve a Professional Services Agreement with JJR, LLC for Phase I Engineering Services for the Fuller Intermodal Transportation Station (FITS) and to Establish the Project Budget of $541,717.00 and Appropriate Project Funds from Economic Development Fund Reserves (8 Votes Required)

Attached for your approval is a resolution to approve a Professional Services Agreement with JJR, LLC in the amount of $541,717.00 for conceptual design, environmental assessment and engineering services related to a Phase I FITS project. Phase I includes three (3) tasks and provides for development of the concept plan for the site, environmental assessment, consideration of site issues and conducting a detailed transportation study to consider the off-site and site access transportation system impacts, and recommended improvements.
The City owns the land containing the existing southern surface parking lot along Fuller Road and has determined that this area is: uniquely suited as adjacent to the existing Amtrak passenger rail service corridor, which is proposed to accommodate commuter rail service linking Ann Arbor to Metro airport and Detroit and has been designated as a national high-speed corridor between Detroit and Chicago; immediately adjacent to the University Medical center campus with thousands of employees and visitors daily; able to provide direct pedestrian access to jobs and medical services; accessible to bus transport via Fuller and East Medical Center Drive and is along a proposed signature transit corridor identified in the City's recent Transportation Plan Update; and adjacent to the Washtenaw County Border to Border Trail.
The City and University desire to jointly develop an intermodal transportation station, currently referred to as the Fuller Intermodal Transportation Station ("FITS"), and shall include in its first phase of development a bus stop, and parking structure with approximately 900 parking spaces and a surface parking lot with approximately 100 parking spaces. Future phases of FITS will be developed such that immediate needs can be accommodated while future phases evolve on their respective timelines. Additional phases of FITS may include elements including additional parking, connections to rail platforms, a rail waiting/ticketing area, an Ann Arbor Transportation Authority and University bus terminal, skywalk connections to the University of Michigan Hospital, linkage with the proposed signature transit corridor identified in the City's Transportation Plan update, as well as other elements.
The detailed Scope of Services including project phasing and budget by task is attached. We are seeking authorization to support work through Task 3 for a total cost of $541,717.00. The University of Michigan by letter commitment has offered to fund 75 percent of Task 1 and Task 2, for a total of $327,733.00. For the balance of this request, Staff is proposing that the City fund 25 percent of Task 1 and Task 2 as well as Task 3- the environmental assessment for $213,985.00 to enable receipt of potential Federal and/or State funds. See attachment 1, JJR Scope of Services.
Staff is prepared to proceed into the first phases of work outlined in Task 1. Site Assessment, Inventory and Survey, Task 2. Program Definition and Concept Planning and Task 3. Environmental Requirements in the attachment immediately. This work is needed to keep the project development moving forward in a manner and schedule consistent with the project's needs, and will provide sufficient detail to confirm project costs estimates, which will enable the City and the University of Michigan to finalize cost participation in the Phase I project development.
JJR has been qualified as the source for providing these services due to their involvement with conducting a preliminary feasibility of FITS on this site and their prior involvement with the earlier Fuller Road Issues Analysis. Given a short timeframe for Deliverable 1, the Phase I development footprint, critical to an in-service date requirement of June, 2012, any other formal procurement process, RFQ, or RFP would not be timely and would cause the project to fail.
JJR is under contract with the City for other projects and maintains compliance with all City contracting requirements.

Whereas, The City and University of Michigan (UM) have collaborated on development of transportation plans including the City's 2009 Transportation Plan update and find continuing to implement planning recommendations as necessary and desirable;
Whereas, The study of the relocation of the Amtrak Station from Depot Street to Fuller Road is identified as a short-term recommendation in the City's 2009 Transportation Plan;
Whereas, The UM desires to co-locate university related parking and transportation services as part of an intermodal facility being considered with the rail station relocation;
Whereas, The City owns the land along Fuller Road and has determined the area is suitable for consideration of an Intermodal Transportation Station;
Whereas, The City has determined that this area is uniquely suited to accommodate commuter rail service linking Ann Arbor to Metro airport and Detroit and has been designated as a national high-speed corridor between Detroit and Chicago;
Whereas, The City and University desire to jointly develop an intermodal transportation station which shall include in its first phase of development a bus stop, and parking structure with approximately 900 parking spaces and a surface parking lot with approximately 100 parking spaces.
Whereas, Additional phases of FITS may include elements including additional parking, connections to rail platforms, a rail waiting/ticketing area, an Ann Arbor Transportation Authority and University bus terminal, skywalk connections to the University of Michigan Hospital, linkage with the proposed signature transit corridor identified in the City's Transportation Plan update, as well as other elements;
Whereas, The City and UM agree to partner in Site Investigation, Project Definition and development of Conceptual Plans for a Fuller Intermodal Transportation Station; and
Whereas, The project can be phased such that the immediate needs can be accommodated while future phases evolve on their respective timelines;
RESOLVED, That Council establish a project budget from the following funding sources as detailed below to be expended during the life of the Project without regard to Fiscal Year:
FY 2010 Major Streets Major Street Fund Operating Budget $54,621.00
FY 2010 Alternative Transportation Approved Capital Budget $54,621.00
FY 2010 Economic Development Fund Reserves $104,742.00
Total City Funds $213,984.00
University of Michigan Contribution $327,733.00
Total Project Budget $541,717.00
RESOLVED, That funding from the Economic Development Fund reserves shall be appropriated for the purposes stated in this Resolution and reimbursed to the Fund reserve to the extent alternate funding sources, through partnerships, grants or other resources, become available during the life of the Project;
RESOLVED, That expenditure of funds from the Project Budget shall not be authorized by the City Administrator until receipt of funds from the University of Michigan which shall be appropriated to the Project budget for expenditure when received;
RESOLVED, That a Professional Services Agreement in the amount of $541,717.00 be awarded to JJR, LLC for Phase I engineering services for the Fuller Intermodal Transportation Station;
RESOLVED, That the Mayor and City Clerk be authorized and directed to execute said contract after approval as to form by the City Attorney, and approval as to substance by the City Administrator; and
RESOLVED, That the City Administrator be authorized to take necessary administrative actions to implement this resolution.
