Resolution to Approve Amendment #1 to the General Services Agreement with Margolis Companies, Inc. for the Purchase, Delivery and Planting of Trees along City Street Rights-of-Way ($160,775.00)

Memorandum

Attached for your review is a resolution to authorize Amendment #1 to the General Services Agreement with Margolis Companies, Inc. (Margolis) in the amount of $160,775.00 for the planting of trees along City street rights-of-way.

 

ITB-4365, Street Tree Planting, was issued on BidNet for the purchase, delivery, and planting of 1,000 trees along City street rights-of-way in FY21. Four bids were received and opened on July 2, 2020. This ITB was subsequently cancelled due to scope-of-services changes and changes in “required to bid” species requirements. 

 

There is still a need to plant trees this fall and Margolis, the City’s FY20 planting contractor, is willing to match current pricing.  ITB-4578, Street Tree Planting, was issued on BidNet for the purchase, delivery, and planting of 1,000 trees along City street rights-of-way. Three bids were received and opened on April 24, 2019. Margolis was the lowest responsible bidder. City staff has been satisfied with the work completed by Margolis and recommend amending this contract to extend their services through the end of the calendar year, December 31, 2020, under the same terms, conditions and pricing of the current contract.

 

The street trees to be planted as part of the project will be planted in areas identified in the FY21 Street Tree Planting Plan (attached).

 

Sustainability Framework: The work completed through this contract will help to achieve tree canopy targets identified in the Urban and Community Forest Management Plan, adopted by City Council in June 2014 (R-14-0696). In addition, it will help further goals in the City’s Sustainability Framework, including Sustainable Systems, Clean Air and Water and Healthy Ecosystem. Trees provide many environmental, social and economic benefits to the city including, decreasing the quantity of stormwater runoff and improving the quality of the runoff that reaches local lakes and streams.

 

Budget/Fiscal Impact: Funding is available in the approved Stormwater Fund Capital Budget.

The resolution includes a 5% contingency in the amount of $8,038.75 to cover potential change orders to be approved by the City Administrator.

Whereas, Ann Arbor’s urban and community forest is a defining and valued characteristic of the City, which residents call “Tree Town;”

 

Whereas, The City’s Urban and Community Forest Management Plan has identified tree planting as an important component in maintaining a sustainable urban forest;

 

Whereas, Trees provide environmental, social and economic benefits to the city, including decreasing the quantity, and the quality, of stormwater runoff;

 

Whereas, Competitive bids for FY20 street tree planting were received by Purchasing on April 24, 2019 and Margolis submitted a bid that offered the most advantageous combination of low price and highest qualifications/experience in performing street tree planting;

 

Whereas, ITB4365 for FY21 street tree planting was issued but was subsequently cancelled due to scope-of-services changes, but there is still a need to plant trees this fall,

 

Whereas, Margolis satisfactorily performed planting as part of FY20 street tree planting contract;

 

Whereas, The current contract sets forth the services to be performed by Margolis and the payments to be made by the City, all of which are agreeable by the City;

Whereas, Funding for this work is included in the approved Stormwater Fund Capital Budget;

 

Whereas, Margolis Company, Inc. complies with the City’s Non-discrimination and Living Wage Ordinances;

 

RESOLVED, That City Council approve Amendment #1 to the General Services Agreement with Margolis Companies, Inc. in the amount of $160,775.00 for the Purchase, Delivery and Planting of Trees along City Street Rights-of-Way (for a total services agreement of $482,325.00);

 

RESOLVED, That a contingency in the amount of $8,038.75 (5%) be established and the City Administrator be authorized to approve change orders to the contract with Margolis Companies, Inc. to satisfactorily complete this project;

 

RESOLVED, That the Mayor and City Clerk be authorized and directed to execute said Amendment #1 after approval as to form by the City Attorney and approval as to substance by the City Administrator; and

 

RESOLVED, That the City Administrator be authorized to take the necessary administrative actions to implement this resolution.
